HomeMy WebLinkAboutORD 1325BILL NO. 17 ORDINANCE NO. 1325 BY COUNCILMAN CARTER AN ORDINANCE TO AMEND TITLE 3, CHAPTER 3, SECTION 8, OF THE CITY CODE OF THE CITY OF CALDWELL COUNTY OF CANYON, STATE OF IDAHO, BY PROVIDING AN ADDITIONAL CHARGE OF TWO DOLLARS AND FIFTY CENTS ($2.50) FOR EACH SEPARATE PREMISES CONNECTED TO A WATER MAIN THROUGH A WATER METER; AMENDING TITLE 3, CHAPTER 3 BY ADDING A NEW SECTION TO BE KNOWN AND DESIGNATED AS TITLE 3, CHAPTER 3, SECTION 29, WHICH SAID SECTION SHALL PROVIDE THAT AFTER THIRTY (30) DAYS NOTICE, THE WATER SUPER- INTENDENT SHALL BE AUTHORIZED AND DIRECTED TO DISCONTINUE WATER SERVICE TO ANY PREMISES WHICH ARE CONNECTED TO THE CITY WATER MAINS BY AN ILLEGAL CONNECTION; PROVIDING THAT THE WATER SHALL NOT BE DISCONTINUED TO ANY PREMISES WHICH ARE CONNECTED TO THE CITY WATER MAINS BY AN ILLEGAL CONNECTION WHICH SAID ILLEGAL EXISTED ON THE DATE OF PASSAGE OF THIS AMENDMENT; PROVIDING THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, THAT: SECTION 1. That Title 3 Chapter 3, Section 8 of the Ordinance of the Municipal Code of the City of Caldwell, be amended to read as follows: 3 -3 -8: WATER RATES: Charges for metered water furnished by the Water Department each month to individual users within the City Limits shall be based upon the following schedule of rates: Two dollars and fifty cents ($2.50) per the first four hundred (400) cubic feet, or fraction thereof; -1- Twenty five cents (250,) per one hundred (100) cubic feet or fraction thereof, for the next additional six hundred (600) cubic feet; Fifteen cents (15�!) per one hundred (100) cubic feet or fraction thereof, for the next additional nine thousand (9000) cubic feet; Seven and one -half (7 -1/2�-) per one hundred (100) cubic feet or fraction thereof, for the next additional fifteen thousand (15,000) cubic feet; and Five cents (5�.) per one hundred (100) cubic feet or fraction thereof, for all excess over twenty five thousand (25,000) cubic feet. Charges for metered water furnished by the Water Department each month to individual users residing outside of the City Limits, where not otherwise governed by private contract between the City and such user, shall be based upon the following schedule of rates: Five dollars ($5.00) per the first four hundred (400) cubic feet, or fraction thereof; Fifty cents (50�) per one hundred (100) cubic feet or fraction thereof, for the next additional six hundred (600) cubic feet; -2- Thirty cents (304�) per one hundred (100) cubic feet or fraction thereof, for the next additional nine thousand (9,000) cubic feet; Fifteen cents (15�,) per one hundred (100) cubic feet or fraction thereof, for the next additional fifteen thousand (15,000) cubic feet; and Ten cents (10�-) per one hundred (100) cubic feet or fraction thereof, for all excess over twenty -five thousand (25,000) cubic feet. Provided, however, that if a meter is used to service more than one (1) separate premise, then and in that event, an additional charge of two dollars and fifty cents ($2.50) shall be made for each separate additional premise. SECTION 2: That Title 3, Chapter 3, Section 29, of the Ordinance of the Municipal Code of the City of Caldwell, be enacted to read as follows: 3 -3 -29: ILLEGAL CONNECTION - NOTICE - DISCONTINUE SERVICE: The City, by and through the Water Superintendent, shall give notice in writing to the owner and /or occupant of any premises connected to and served by City water mains in all cases in which said connections are illegal or in violation of the rules and rezulations of the Citv or arovisions of this Chapter. -3- Said notice shall state the violation and require that the violation be cured within thirty (30) days from notice thereof or water service will be discontinued. In the event that said illegal connection continues beyond the thirty (30) day period, the City is authorized to discontinue water service to said premises without further notice and until said illegal connection is discontinued. Provided however, that this Section shall be applied prospectively from and after passage and approval of this Act, and water will not be discontinued to any premises based upon this Amendment as a result of any illegal connection, which said illegal con- nection existed on the date of passage and approval of this Act. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. This ordinance shall be in full force and effect from and after passage, approval and publication according to law. PASSED BY THE COUNCIL of the City of Caldwell, this 13th day of May , 1974.
