AN ORDINANCE TO AMEND TITLE 1, CHAPTER 15, OF THE CITY CODE
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY REPEALING
SAID CHAPTER IN ITS ENTIRETY AND BY SUBSTITUTING THEREFOR A
NEW CHAPTER 15, TITLE 1, CREATING PARK AND RECREATION DEPART-
MENT OF THE CITY OF CALDWELL; PROVIDING FOR THE POWERS AND
DUTIES OF SUCH DEPARTMENT; PROVIDING FOR A DIRECTOR OF PARKS
AND RECREATION; AND TO AMEND TITLE 2, CHAPTER 4, SECTION 6,
OF THE CITY CODE OF CALDWELL, COUNTY OF CANYON, STATE OF
IDAHO, BY CHANGING THE RESPONSIBILITY OF THE RECREATION
BOARD, CITY OF CALDWELL, TO AN ADVISORY BOARD; AND REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, THAT:
SECTION 1. That Chapter 15, Title 1, of the
Ordinance of the Municipal Code of the City of Caldwell, be,
and the same is hereby repealed.
SECTION 2. That Chapter 15, Title 1, of the
Ordinance of the Municipal Code of the City of Caldwell, be,
and the same is hereby enacted to read as follows:
1 -15 -1: PARK AND RECREATION DEPARTMENT, CREATION OF.
For the purpose of providing for the proper maintenance
and operation of public parks, playgrounds, gardens, swimming
pools, and other recreational facilities belonging to the City
of Caldwell, and to provide for the acquisition of Land,
structures, and other facilities for the park and recreational
program of the City, there is hereby created and established a
department of said City to be known as the Municipal Park and
Recreation Department, hereinafter called "the department."

1 -15 -2: POWERS AND DUTIES OF THE DEPARTMENT. The department
shall have all of the powers and perform all duties
provided by the laws of the State of Idaho relating to parks
and recreational facilities in cities of the State of Idaho.
The department shall have the power to conduct any form of
recreational or cultural activity that will employ the leisure
time of the prople in a constructive and wholesome manner,
and shall have control and supervision of all parks belonging
to said City, and may plan, promote, manage and acquire,
construct, develop, maintain and operate, either within or
without the city limits, parks, squares, parkways, boulevards,
gardens, play and recreation grounds, swimming pools, and /or
other municipally owned recreational facilities, including
community buildings and improve and ornament the same.
1 -15 -3: APPOINTMENT AND DUTIES OF DIRECTOR. The Mayor shall
appoint a Director of Parks and Recreation subject
to confirmation by the City Council, who is trained and
qualified for that position, and he shall be the head of the
department. The department shall have charge of the management
of the park and playground system and of the swimming pool and
swimming facilities, and of the appointment and supervision
of qualified employees thereof for the efficient administration,
construction, development of the public park, gardens, swimming
pool, and recreation system. The Director shall have such
other powers and duties as may from time to time be imposed
and conferred upon him by law or by ordinance.
1 -15 -4: RULES AND REGULATIONS. The department shall have
power to make rules and regulations for the govern-
ment and management thereof.

SECTION 3. That Section 6, Chapter 4, Title 2, of
the Ordinance of the Municipal Code of the City of Caldwell,
be, and the same is hereby amended to read as follows:
2 -4 -6: DUTIES. The Recreation Board shall have- eke- fallaw-

(A) The planning and conduct of the summer recreation program

(B) The operation, maintenance, control and supervision of

and all other things as may be necessary to the maintenance

SECTION 4. That all ordinances or parts of
ordinances in conflict herewith are hereby repealed.
SECTION 5. This ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
