AN ORDINANCE TO AMEND TITLE 1, CHAPTER 7, SECTION 1, OF THE CITY
CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY STRIKING
ENGINEER FROM APPOINTIVE OFFICERS AND ADDING POSITIONS OF ENGINEER-
ING AND PLANNING DIRECTOR, AND PUBLIC WORKS SUPERVISOR; AND TO
AMEND TITLE L, CHAPTER 9, OF THE CITY CODE OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO, BY REPEALING SAID CHAPTER IN ITS ENTIRETY
AND BY SUBSTITUTING THEREFOR A NEW CHAPTER 9 CREATING OFFICE OF
ENGINEERING AND PLANNING DIRECTOR, AND PROVIDING FOR APPOINTMENT
AND DUTIES; ENACTING TITLE 1, CHAPTER 22, OF THE CITY CODE OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, CREATING OFFICE OF
PUBLIC WORKS SUPERVISOR AND PROVIDING FOR APPOINTMENT AND DUTIES;
AND TO AMEND TITLE 1, CHAPTER 11, SECTION 2, OF THE CITY CODE OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY PROVIDING THAT THE
BUILDING OFFICIAL SHALL BE UNDER THE DIRECT SUPERVISION OF THE
MAYOR RATHER THAN ENGINEER.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, THAT:
SECTION 1: That Section 1, Chapter 7, Title 1, of the
Ordinance of the Municipal Code of the City of Caldwell, be, and
the same is hereby amended to read as follows:
1 -7 -1: APPOINTMENTS: The Mayor shall appoint, subject
to the approval of the Council, a Clerk, Attorney, Eng -Ineep,
Engineering and Planning Director Public Works Supervisor Police
Chief, Fire Chief and Treasurer. The Mayor may appoint, subject
to approval by the Council, such other officers as may be deemed
necessary for the efficient operation of the business of the
Municipality.
SECTION 2: That Chapter 9, Title 1, of the Ordinance
of the Municipal Code of the City of Caldwell, be repealed
SECTION 3: That Chapter 9, Title 1, of the Ordinance
of the Municipal Code of the City of Caldwell, be enacted to
read as follows:
1 -9 -1: APPOINTMENT: There is hereby created the office
of Engineering and Planning Director, a technical office of the
City. The Engineering and Planning Director shall be appointed
by the Mayor, with the advice and consent of the Council, and
shall hold office for the duration of his appointment or until
such time as he may be removed by the appointing authority.
1 -9 -2: QUALIFICATION: Any person appointed as
Engineering and Planning Director shall be a competent, qualified
engineer and shall be duly licensed by the State of Idaho.
1 -9 -3: DUTIES: The Engineering and Planning Director
shall be responsible for all duties imposed upon engineer by the
Laws of the State of Idaho or by the provisions of this Code. In
addition thereto he shall have the following duties:
(A) Supervise and administer the engineering department
of the City of Caldwell.
(B) Prepare plans, specifications and estimates of
public works projects as directed by the Mayor
and Council.
(C) Administer contracts for engineering work
performed by consultants.
(D) Perform all engineering work relating to drafting
maps for use by the City, street designs, rights-
of-way, general sewer design, benchmark system
and right -of -way encroachment permits.
(E) Assist City Planning Commission in performance of
its duties as set forth by law.
(F) Administer subdivision ordinance of City.
(G) Perform general planning work as directed by
the Mayor and Council Comprehensive Planning
for the City.
(H) Integrate Caldwell planning with the work of the
Canyon Development Council.
(I) Become familiar with state and federal grant
programs and planning requirements necessary
for local, state and federal needs.
(J) Coordinate local, state and federal comprehensive
planning whenever City of Caldwell participates
in joint governmental planning programs.
SECTION 4: That Chapter 24, Title 1, of the Ordinance
of the Municipal Code of the City of Caldwell be enacted to read
as follows:
1 -24 -1: APPOINTMENT: There is hereby created the office
of Public Works Supervisor. The Public Works Supervisor shall be
appointed by the Mayor, with the advice and consent of the
Council, and he shall hold office for the duration of his
appointment or until such time as he may be removed by the
appointing authority.
1 -24 -2: DUTIES: (A) The Public Works Supervisor shall
be responsible for developing, coordinating and carrying out all
functions and services of the City of Caldwell relating to
departments and services of the following:
(1) Streets
(2) Water - Irrigation
(3) Sewers and Sewer Treatment Plant
(4) City Shop
(B) In each city department responsible for each of these
services the Public Works Supervisor will develop an
organization chart providing line of authority within
each department and providing that each department
head is responsible to the Public Works Supervisor.
Said organizational chart shall provide for positions
and responsibility within each department.
(C) The Public Works Supervisor will be responsible for
hiring and dismissing all employees and other per-
sonnel of these departments. Provided, however, that
each department head shall be hired and dismissed only
upon approval of the Mayor and City Council.
(d) The Public Works Supervisor will be responsible for
developing plans for and coordinating all vacations,
compensatory time, leave, budgets, expenditures and
purchases of major equipment within these departments
and will report regularly to the Mayor.
SECTION 5: That Section 2, Chapter 11, Title 1, of the
Ordinance of the Municipal Code of the City of Caldwell, be, and
the same is hereby amended to read as follows:
1 -11 -2: DUTIES: It shall be the duty of the Building
Official to supervise the operations of the Building Department
relating particularly to the enforcement of the building, housing,
and zoning regulations applying to the use of property, construction,
alteration, or removal of structures and buildings, and including
the issuance of such licenses and permits as may be required in
such regulation. He shall work under the direct supervision of
the Engiineev and the Mayor.
It shall be his further duty to examine all plans and
applications for permits for buildings and structures to be con-
structed, altered, repaired, moved, or removed and inspect or
direct inspection of such construction or use to assure compliance
with all the provisions of this Code relating to building, zoning,
housing, plumbing, electrical wiring, and gas installations.
He shall perform such other duties as may be prescribed
for Building Official by the Mayor or the Council.
SECTION 6: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 7: This ordinance shall be in full force and
effect from and after its passage, approval and publication accord-
ing to law.
