ORDINANCE NO. 1311

AN ORDINANCE TO AMEND TITLE 6, CHAPTER 4, SECTION 4, OF THE CITY
CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO,
BY REPEALING SECTION 4 OF SAID TITLE 6, CHAPTER 4 OF THE CITY
CODE, AND BY SUBSTITUTING THEREFOR A NEW SECTION 4 AS HEREINAFTER
SET FORTH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Title 6, Chapter 4 of the City Code
of Caldwell, County of Canyon, State of Idaho, be amended by
deleting therefrom Section 4 of said Title 6, Chapter 4.
Section 2. That Title 6, Chapter 4 shall be further
amended by adding thereto the following which shall be designated
as Section 4, to wit:
6 -4 -4: AREAS.
(A) In the "CD" Commercial Zone along the North-
easterly side of Cleveland Boulevard. from the Wilson
Drain to Ustick Road and on the Southwesterly side of
Cleveland Boulevard from Lake Avenue to Ustick Road
every building hereafter erected or structually altered
shall have a setback of at least twenty feet (20 from
the street property line.
(B) In the "CD" Commercial Zone along the
Southwesterly side of Cleveland Boulevard from the
Wilson Drain to Lake Avenue every building hereafter
erected or structurally altered shall have a setback
of at least eight feet (8 from the street property line.
(C) No front or side yards, except as set forth
in Sections (A) and (B), shall be required except that

when a building or group of buildings abuts upon a
residential zone a yard shall be provided on the side
of the lot abutting the residential zone, such yard
having a width of not less than ten feet (10 There
shall be a rear yard with a depth of not less than
fifteen feet (15') when abutting upon a public thorough-
fare and not less than twenty feet (20 when no
dedicated alley or public way exists at the rear of
the lot. The rear yard may be used for off - street
parking and loading as provided in this Title.
Section 3. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
PASSED By the Council of the City of Caldwell, this
19th day of November, 1973.
