ORDINANCE NO. 1305

AN ORDINANCE RECITING THE PASSAGE, APPROVAL AND PUBLICATION OF
ORDINANCE NO. 1302 DETERMINING THAT NO OBJECTIONS TO THE
VACATION OF LAUREUSTREET IN PLEASANT RIDGE NO. 2 ADDITION TO
CALDWELL, CANYON COUNTY, IDAHO, HAVE BEEN MADE OR FILED, THE
SAID LAUREL STREET BEING DESCRIBED AS FOLLOWS, TO WIT:
Beginning at the Northwest corner of Lot 1 of Block 13
of the Pleasant Ridge No. 2 Addition to Caldwell, Idaho,
as shown on the official plat of record and on file in
the office of the Recorder of Canyon County, Idaho; thence
North 0 -42' West, 32.30 feet; thence North 22 ° -28' West
30.00 feet to the Southwesterly corner of Lot 3 of
Block 12 of the said Pleasant Ridge No. 2 Addition;
thence North 67'-32 East, 470.85 feet to the South-
easterly corner of Lot 4 of said Block 12; thence South
24 ° -42' West, 60.05 feet to the Northeasterly corner of
Lot 5 of Block 13 of the said Pleasant Ridge No. 2
Addition; thence South 67 ° -32' West, 482.83 feet to the
Point of Beginning;
DETERMINING THAT THE VACATION OF SAID LAUREL STREET ABOVE DESCRIBED
IS IN THE PUBLIC INTEREST; PROVIDING THAT THE TITLE TO SAID LAUREL
STREET ABOVE DESCRIBED AS VACATED, SHALL REVERT TO THE PERSONS
DEDICATING THE SAME, THEIR SUCCESSORS, HEIRS AND ASSIGNS, SUBJECT TO
ALL UTILITY COMPANIES AND ALL EASEMENT RIGHTS IN THE AREA, IF ANY,
PERTAINING TO SEWER LINES, POWER LINES, TELEPHONE LINES AND GAS
LINES, TOGETHER WITH ACCESS TO AND FROM SAID AREA TO MAINTAIN,
REPAIR OR REPLACE THE SAME'.; AND SPECIFICALLY RESERVING UNTO THE CITY
OF CALDWELL, IDAHO, A UTILITY EASEMENT DESCRIBED AS FOLLOWS, TO WIT:
Beginning at the Northeasterly corner of Lot 1 of Block 13 of
Pleasant Ridge No. 2 Addition to Caldwell, Idaho, as shown on
the original plat of record and on file in the office of the
Recorder of Canyon County, Idaho; thence South 67 ° 32' West,
10.04 feet; thence North 27 West, 60.27 feet; thence
North 67 ° 32' East, 20.09 feet; thence South 27 ° 54 1 30" East,
60.27 feet; thence South 67 ° 32' West, 10.05 feet to the Point
of Beginning.
BE IT ORDAINED By the Mayor and Council of the City
of Caldwell, Idaho:
Section 1. That by Ordinance No. 1302 passed by the
Council and approved by the Mayor of the City of Caldwell, Idaho,
on the 6th day of August, 1973, and published in The News - Tribune,
a newspaper published in the City of Caldwell, Idaho, in two issues
thereof on the 11th day of August, 1973 and on the 18th day of
August, 1973, notice was given to citizens and owners of property
in Canyon County, State of Idaho, within one mile of the boun-
daries of the City of Caldwell, Idaho, that an application has
been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting the passage and approval of an ordinance
vacating Laurel Street in Pleasant Ridge No. 2 Addition to
Caldwell, Canyon County, Idaho, which street is hereinabove
described, subject to the reservations of all utility companies
and all existing easement rights in the area comprising easement
rights for sewer lines, power lines, telephone lines and gas
lines as presently located thereon or therein, with the further
reservation to the City of Caldwell, if applicable, and all
utility companies with easement rights in the area comprising
said easement rights for access to and from said area to maintain,
repair or replace the present existing sewer, power, telephone
and gas lines as presently located thereon or therein, and
specifically reserving unto the City of Caldwell, Idaho, a utility
easement described as follows, to wit:
Beginning at the Northeasterly corner of Lot 1 of
Block 13 of Pleasant Ridge No. 2 Addition to Caldwell,
Idaho, as shown on the original plat of record and on
file in the office of the Recorder of Canyon County,
Idaho; thence South 67 West, 10.04 feet; thence
North 27 ° 54 1 30" West, 60.27 feet; thence North 67 ° 32'
East, 20.09 feet; thence South 27 ° 54 1 30" East, 60.27
feet; thence South 67 ° 32' West, 10.05 feet to the
Point of Beginning.
Section 2. That no objections to the granting of said
application have been made or filed; and it is hereby determined
that it is to the best public interest that the said Laurel
Street above described be vacated subject to existing easement
rights and further easement rights as hereinabove set forth.
Section 3. Be it ordained and established that Laurel
Street above described, from and after the passage, approval
and publication of this ordinance, shall be vacated and shall
no longer be open or subject to the use of the public; and
thereupon the title to said Laurel Street above described shall
pass and revert to the persons dedicating the same or their
successors, heirs and assigns, subject to existing easement
rights in the area comprising easements for serer lines, power
lines, telephone lines and gas lines as presently located thereon
or therein, with the further reservation to all utility companies
with easement rights in the area for access to and from said
area to maintain, repair orxeplace the present existing sewer,
power, telephone and gas lines as presently located thereon or
therein, and specifically reserving unto the City of Caldwell,
Idaho, a utility easement as hereinabove described.
Section 4. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
PASSED By the Council of the City of Caldwell, this
4th day of September, 1973.
