ORDINANCE NO. 1303

AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND CITY COUNCIL
INTEND TO SELL THE FOLLOWING DESCRIBED REAL PROPERTY OWNED BY
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AND WHICH SAID
PROPERTY IS SITUATED IN THE CITY OF CALDWELL AND IS KNOWN AS THE
CALDWELL MUNICIPAL AIRPORT OF THE CITY OF CALDWELL, CANYON COUNTY,
IDAHO; THAT SAID SALE IS MADE UNDER THE PROVISIONS OF TITLE 50,
CHAPTER 14, IDAHO CODE; THAT SAID SALE OF SAID PROPERTY SHALL BE
AT PUBLIC AUCTION AND SHALL BE SOLD TO THE HIGHEST BIDDER AND THAT
NO BID SHALL BE ACCEPTED FOR LESS THAN THE APPRAISED VALUE WHICH
IS $476,550.00; SAID PROPERTY BEING DESCRIBED AS FOLLOWS, TO WIT:
All of the Southwest Quarter of Section 21, Township 4 North,
Range 3 West of the Boise Meridian, excepting therefrom the
following tracts of land:
Exception No. 1
The East 110.00 feet for the right -of -way of Airport Avenue.
Exception No. 2
The South 80 feet for the right -of -way of Laurel Street.
Exception No. 3
The following described tract for the right -of -way of
Marsing Boulevard:
Beginning at the West Quarter corner of said Section 21;
thence South 0° 21' West, 2,628 feet to the Southwest
corner of said Section 21; thence South 89 54' East,
85.4 feet along the South line of said Section 21; thence
North 0 05' East, 2,628.6 feet to a point in the North
line of the Southwest Quarter of said Section 21; thence
South 89° 32' West 69.3 feet along said North line to
the Point of Beginning.
Exception No. 4
The right -of -way of the Wilder Branch of the Oregon Short
Line of the Union Pacific Railroad and the right -of -way of
State Highway 19.
Exception No. 5
The following tract of Land:
Beginning at the Northeast corner of the Southwest
Quarter of said Section 21; thence South 152.30 feet
along the East line of the aforesaid Southwest Quarter
to the South line of the right-of-way of the Wilder
Branch of the Oregon Short Line of the Union Pacific
Railroad; thence South 89° 03' 30" West along the
aforesaid railroad right -of -way line, 110.00 feet

to the True Point of Beginning; thence South and
parallel with the East line of the aforesaid South-
west Quarter, 730.00 feet; thence South 89 03' 30"
West, 1,125.00 feet; thence North and parallel with
the East line of the.aforesaid Southwest Quarter
408.31 feet; thence South 88° 59' West, 66.68 feet;
thence North 0' 04' West 328.08 feet to the South
right -of -way line of said Wilder Branch of the Oregon
Short Line of the Union Pacific Railroad; thence
North 89° 03' 30" "East along the aforesaid right -
of -way line, 290.36 feet; thence South along the
aforesaid right -of -way line, 6.30 feet; thence
North 89 03' 30" East along the aforesaid right -of-
way line 901.70 feet to the True Point of Beginning.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL
OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and the Council of the City
of Caldwell, Idaho, hereby intend to sell at public auction the
following described real property situated within the City of
Caldwell, Canyon County, Idaho, said property being described as
follows, to wit:
All of the Southwest Quarter of Section 21, Township 4 North,
Range 3 West of the Boise Meridian, excepting therefrom the
following tracts land:
Exception No. 1
The East 110.00 feet for the right -of -way of Airport Avenue.
Exception No. 2
The South 80 feet for the right -of -way of Laurel Street.
Exception No. 3
The following described tract for the right -of -way of Marsing
Boulevard:
Beginning at the West Quarter corner of said Section 21;

Exception No. 5
The following tract of land:
Beginning at the Northeast corner of the Southwest
Quarter of said Section 21; thence South 152.30 feet
along the East line of the aforesaid Southwest Quarter
to the South line of the right -of -way of the Wilder
Branch of the Oregon Short Line of the Union Pacific
Railroad; thence South 89° 03' 30" West along the
aforesaid railroad right -of -way line, 110.00 feet
to the True Point of Beginning; thence South and
parallel with the East line of the aforesaid South-
west Quarter, 730.00 feet; thence South 89 03' 30"
West, 1,125.00 feet; thence North and parallel with
the East line of the aforesaid Southwest Quarter
408.31 feet; thence South 88 59' West, 66.68 feet;
thence North 0 04' West 328.08 feet to the South
right -of -way line of said Wilder Branch of the Oregon
Short Line of the Union Pacific Railroad; thence
North 89° 03' 30" East along the Aforesaid right -
of -way line 290.36 feet; thence South along the
aforesaid right -of -way line, 6.30 feet; thence
North 89° 03' 30" East along the aforesaid right -of-
way line 901.70 feet to the True Point of Beginning.
Section 2. That the ordinance for the sale of said
above described real property will be considered under a suspen-
sion of the requirements that an ordinance be read on three dif-
ferent days at a meeting of the Council of the City of Caldwell,
Idaho, to be held on the 5th day of November, 1973, at the hour
of eight o'clock p.m. at the council chambers in the City Hall
in the City of Caldwell, Idaho, when and where, or prior to said
date, any citizen of the City of Caldwell, Idaho, or any number
of citizens may express dissatisfaction with said sale as set
forth in Section 50 -1403 Idaho Code wherein it is provided that
if a petition expressing dissatisfaction with said sale containing
the names of qualified electors of the city in a n umber equal to
ten percent (10 %) of the total votes cast for mayor at the preced-
ing city election is filed with the City Clerk during sixty (60)
days from the passage of this ordinance, the City Council shall
cause a special election to be held on the question of whether
or not the real property shall be sold.

The said property above described shall reserve unto
the City of Caldwell, Canyon County, Idaho, a well site which
shall be a square 200 feet by 200 feet.
Section 3. The said above described property shall be
sold at public auction to the highest bidder and no bid shall
be accepted for less than the appraised price which is
$476,550.00, and the City Council may reject any and all bids.
Section 4. Notice of the foregoing will be given to
all citizens of the City of Caldwell, Canyon County, Idaho, by
publication of this ordinance in The News- Tribune, a newspaper
published in the City of Caldwell, Idaho, in three issues thereof
published on the 25th day of August, 1973, the lst day of Septem-
ber, 1973, and the 8th day of September, 1973.
Section 5. That this ordinance shall be in force and
effect from and after its passage, approval and publication.
