ORDINANCE NO. 1293

AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF
PROPERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION HAS
BEEN PRESENTED FOR THE VACATION OF A PORTION OF 6th AVENUE
WITHIN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, SAID PORTION
BEING DESCRIBED AS FOLLOWS, TO WIT:
Beginning at the West corner of Lot 1 of Block 39 of
the Original Townsite of Caldwell, Idaho, as of Record
and on file in the office of the Recorder of Canyon
County, Idaho;
thence Northwesterly, along the Southwest boundary
of said Block 39 extended, 10.00 feet;
thence Northeasterly, parallel with the Northwest
boundary of said Block 39, 120.00 feet;
thence Southeasterly, along the Northeast boundary
of Lot 1 of said Block 39 extended, 10.00 feet;
thence Southwesterly, along the Northwest boundary
of said Block 39, 120.00 feet to the Point of Beginning.
BE IT ORDAINED AND ESTABLISHED By the Mayor and the
Council of the City of Caldwell, Idaho:
Section 1. That an application has been presented to
the Mayor and Council of the City of Caldwell, Idaho, for the
passage and approval of an ordinance vacating a portion of
6th Avenue within the City of Caldwell, Canyon County, Idaho,
the said portion to be vacated is described as follows, to wit:
Beginning at the West corner of Lot 1 of Block 39 of
the Original Townsite of Caldwell, Idaho, as of Record
and on file in the office of the Recorder of Canyon
County, Idaho; f
thence Northwesterly, along the Southwest boundary
of said Block 39 extended, 10.00 feet;
thence Northeasterly, parallel with the Northwest
boundary of said Block 39, 120.00 feet;
thence Southeasterly, along the Northeast boundary
of Lot 1 of said Block 39 extended, 10.00 feet;
thence Southwesterly, along the Northwest boundary
of said Block 39, 120.00 feet to the Point of Beginning.
Section 2. That said application will be considered
under a suspension of the requirements that an ordinance be read
on three different days at a meeting of the Council of the City
of Caldwell, Idaho, to be held on the 16th day of April, 1973,
at the hour of eight o'clock p.m. at the Council Chambers in
the City Hall in the City of Caldwell; when and where, or prior
to which date any citizen of the City of Caldwell or any owner
of property in the City of Caldwell may file with the Clerk of the
City of Caldwell any claim for damages which any such citizen
or owner of property may sustain by reason of the vacation of
the said property and all claims for damages so filed will be
considered and ascertained by the Council of the City of
Caldwell at said meeting.
Section 3. Notice of the foregoing will be given to
all citizens of, and owners of property in the City of Caldwell,
Idaho, by publication of this ordinance in The News- Tribune, a
newspaper published in the City of Caldwell, Idaho, in one issue
thereof published on April 7, 1973.
PASSED By the Council of the City of Caldwell this 2nd
day of April, 1973.
