ORDINANCE NO. 1285

AN ORDINANCE TO AMEND TITLE 4, CHAPTER 13, SECTION 1, OF THE CITY
CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY ADDING
THERETO A NEW PARAGRAPH AS HEREINAFTER SET FORTH, WHICH SHALL BE
DESIGNATED AS (A); AND TO AMEND TITLE 4, CHAPTER 13, SECTION 2 OF
THE CITY CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY
REPEALING IN ITS ENTIRETY THE PRESENT SECTION 2 AND BY SUBSTITUT-
ING THEREFOR A NEW SECTION 2 AS HEREINAFTER SET FORTH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Title 4, Chapter 13, Section 1 of
the City Code of Caldwell, County of Canyon, State of Idaho, be
amended by adding thereto the following:
(A) All applications for a license must be in
writing and filed with the Clerk. Every applicant for
a license under this Chapter shall state his full name,
or if more than one (1) person, or if an association
or corporation, the full names of all parties interested,
or the name of the corporation. The application shall
also state the following:
(A) The exact location including street and number
where said billiard, pool or bagatelle hall
or card room is to be operated and maintained.
(b) The name under which the billiard, pool or
bagatelle hall or card room will be maintained
and operated.
All licenses shall be granted by the Mayor and
Council for a period of one (1) year beginning
January 1 and ending December 31. A full year's
license fee shall be collected for each license
issued. All license fees shall be paid in advance.
Section 2. That Title 4, Chapter 13 of the City Code
of Caldwell, County of Canyon, State of Idaho, be amended by
deleting therefrom the present Section 2 in its entirety, and that
the following shall constitute Title 4, Chapter 13, Section 2:
4 -13 -2: FEES: Before a license shall be issued
to operate or open a billiard, pool or bagatelle hall
or card room the person, partnership, association or
corporation, as the case may be, shall pay to the Clerk
a license fee as follows:
(A) An annual fee of $60.00 for a card room.
(B) An annual fee of $60.00 for a billiard, pool
or bagatelle hall.
Said license shall expire on the last day of each calendar
year. The license issued by virtue of this Chapter
shall be non- transferable.
Section 3. That all' "ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage, approval and publication accord-
ing to law.
