HomeMy WebLinkAboutORD 1260BILL NO. 20 ORDINANCE NO. 1260 BY COUNCILMAN G A AN ORDTNANCE TO AMEND TITLE 4 OF THE CITY CODE OF CALDWELL, COUNTY. OF CANYON, STATE OF IDAHO, BY ADDING THE FOLLOWING, WHICH SHALL BE DESIGNATED AS CHAPTER 20 OF SAID TITLE 4 OF SAID CODE: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO: Section 1. That Title 4 of the City Code of Caldwell, County of Canyon, State of Idaho, shall be amended by adding the following which shall be designated as Chapter 20 of said Title 4 of said City Code: 4 -20 -1 ESCORT SERVICE; LICENSE REQUIRED: No person shall engage in the business or occupation of an escort service unless or until they obtain a license to do so. Application for such license shall be made to the Mayor and Council, which appli- cation shall show: (A) The names, ages and addresses of all persons having an interest in said business. (B) The present and previous occupations covering a period of three (3) years of all persons having an interest in the business. (C) The name of the business and the location of business address. (D) The recommendations of at least three (3) reputable citizens of the City that such license be granted. 4 -20 -2 ESCORT OFFICER; PERMIT REQUIRED: No person shall be engaged as, or shall perform the services of, an escort officer unless or until he obtains a permit to do so. Applica- tions for such permit shall be made to the Chief of Police and shall show: b (A) Name, age and resident address of the applicant. (B) Present and previous occupation covering a period of three (3) years prior to the date of application. _,(C) The number of years the applicant has operated a motor vehicle or motorcycle, or both. (D) Recommendations of at least three (3) reputable citizens of the City that such permit be granted. In addition, each applicant shall submit to having his fingerprints taken by the City Police Department and shall produce for copying, at the discretion of the Chief of Police, the operator's license issued to him under Title 49, Chapter 3, Idaho Code. 4 -20 -3 QUALIFICATIONS FOR PERMIT: A permit shall not be issued to any person to act as an escort officer unless: (A) They are at least twenty -one (21) years of age. (B) They have resided within the State for a continuous period of at least six (6) months preceding the date of application. (C) They have not been convicted in any court within a period of two (2) years of an offense of driving a motor vehicle while under the influence of intoxicating liquor or drugs, reckless I driving, the use of drugs or marijuana or any felony. (D) They have completed a minimum of forty (40) hours of training in traffic direction and control certified to by certificate or competent authority on traffic direction. 4 -20 -4 FEES; ISSUANCE: If the Council shall so order, the Clerk shall upon payment of a license fee of twenty -five ($25) dollars issue a license for an escort service which shall be in the form of a placard or certificate whieh shall contain the name of the licensee and the year for which issued. If the Chief of Police determines the applicant eligible, he shall upon payment of a permit fee of five ($5) dollars, issue i_ a permit for an escort officer which shall be in the form of an identification card so as to identify the occupation of the permitee and the year for which issued. The license and permits herein provided shall be issued for a calendar year and may be renewed by the Clerk and Chief of Police respectively upon application for renewal and payment of the license fee provided herein. 4 -20 -5 LIMITATIONS: Any license or permit issued hereunder shall be limited to the licensee to provide escort service for, and to escort, funeral processions and moving buildings only, I unless special permission is obtained to escort other types of traffic movements with the authorization of the Chief of Police. 4 -20 -6 FUNERAL PROCESSIONS: Each motor vehicle parti- cipating in a funeral procession shall display illuminated head- lights and shall follow not to exceed thirty feet (30 behind the preceding vehicle, and when accompanied by police escort or adequate escort service shall have the right -of -way at street intersections over vehicles,, except authorized emergency vehicles. Escort shall mean an escort consisting of at least one (1) escort vehicle for the first twelve (12) vehicles included in the funeral procession, and one (1) additional escort vehicle for each addi- tional twenty -five (25) vehicles included in the funeral procession. 4 -20 -7 ESCORT VEHICLES TO BE IDENTIFIED: Each escort service vehicle shall be equipped with a minimum of two (2) yellow lights of a minimum of four (4) inches in diameter that flash to the front of said escort vehicle while escorting within the City. 4-20 -8 DIRECTION OF TRAFFIC PERMITTED: Persons holding a permit and while engaged in escort service are authorized to direct traffic in accordance with the provisions of this Code and the Statutes of the State, and it shall be unlawful for any person to fail or refuse to comply with any order, signal or direction of an escort officer while so engaged. 4 -20 -9 VIOLATION: It shall be unlawful for any person to violate any provisions of this Chapter, and any license or permit issued under the provisions of this Chapter may be revoked upon conviction of a violation of any of the provisions of this Chapter. Section 2. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
