HomeMy WebLinkAboutORD 1259.1 jo' I . 0 11 A BILL NO. 19 ORDINANCE NO. 1259 BY COUNCILMAN Deken i AN ORDINANCE TO AMEND TITLE 3, CHAPTER 3, SECTION 25, OF THE CITY CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Title 3, Chapter 3, Section 25, of the City Code of Caldwell, County of Canyon, State of Idaho, be amended to read as follows: 3 -3 -25: SEWER SERVICE CHARGE RATES: There is hereby levied and imposed on all users of the City sewer system, for use, maintenance, operation, exten- sion and reconstruction of the Municipal sewage facili- ties consisting of interceptor sewer lines and sewage treatment plant charges per month established as follows: (A) Sewer charges for buildings constructed for the use of dwellings, the basic monthly sewer charge for each such building shall be One and no /100 ($1.00) Dollars and a monthly charge equal to sixty percent (60%) of the average charge made to such buildings for the months of December, January, and February immediately preceding. Provided, however, that the monthly water charge for said months of December, January and February immediately preceding shall be reduced by fifty cents (50¢). Where any building was not receiving water and water service for such preceding three (3) months, it shall be assumed that the water bill for each I of said preceding months would have been the minimum monthly charge then in effect. (B) For buildings constructed for use for com- mercial purposes, the basic monthly sewer charge for each such building shall be One and no /100 ($1.00) Dollars and a monthly charge equal to seventy -five percent (75 %) of the current monthly water charge. For the purpose of determining the sewer service oharge, the monthly water charge shall be reduced by fifty cents (50¢) . The sewer service charge shall be seventy -five percent (75 %) of the current monthly water charge after the above stated adjustment has been made. (C) Providing further that fifty cents (50�) of each of the basic one ($1.00) dollar charges made in Sections A and B above shall be designated and used exclusively for the improvement of the City of Caldwell sewer system. Prorated monthly assess- ments may be made as provided in Title 3, Chapter 3, Section 28 of the Caldwell City Code. For all structures not coming within either of the above classifications, including such structures as those presently used by the Dairymen's Cooperative Creamery of Boise Valley and the Idaho Meat Packers, and for structures to which water is supplied from sources other than the Municipally owned water system, sewer charges shall be fixed in such amounts as may be recommended by the City Engineer and approved t by the City Council. (Res. 14; 8- 2 -65). Section 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED BY THE COUNCIL of the City of Caldwell, this 1st day of ..
