ORDINANCE NO. 1217

AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF
PROPERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION
HAS BEEN PRESENTED FOR THE VACATION OF IRVING STREET FROM SIXTH
AVENUE TO PAYNTER AVENUE WITHIN THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO.
BE IT ORDAINED AND ESTABLISHED By the Mayor and the
Council of the City of Caldwell, Idaho:
Section 1. That an application has been presented to
the Mayor and Council of the City of Caldwell, Idaho, for the
passage and approval of an ordinance vacating a portion of
Irving Street within the City of Caldwell, Canyon County, Idaho,
the said portion to be vacated is described as follows, to wit:
All of Ninth Street South, now known as Irving Street,
from the Southeast boundary of Third Avenue, now known
as Fifth. Avenue, to the Northwest boundary of Second
Avenue, now known as Sixth Avenue, according to the
plat of Hasbrouck's Resubdivision of Block 138,
Strahorn Addition and Lots 22, 24, 25 and 28 of Fair
Acres Addition to Caldwell, Idaho, Section 28, Town-
ship 4 North, Range 3 West of the Boise Meridian as
shown on the official plat thereof on file and of
record in the office of the Recorder of Canyon
County, Idaho. A�_
Section 2. That said application will be considered
under a suspension of the requirements that an ordinance be read
on three different days at a meeting of the Council of the City
of Caldwell, Idaho, to be held on the 6th day of March, 1972,
at the hour of eight o'clock p.m. at the Council Chambers in the
City Hall in the City of Caldwell; when and where, or prior to
which date any citizen of the City of Caldwell or any owner of
property in the City of Caldwell may file with the Clerk of the
City of Caldwell any claim for damages which any such citizen
or owner of property may sustain by reason of the vacation of the
said property and all claims for damages so filed will be
considered and ascertained by the Council of the City of
Caldwell at said meeting.
Section 3. Notice of the foregoing will be given to
all citizens of, and owners of property in the City of Caldwell,
Idaho, by publication of this ordinance in The News - Tribune, a
newspaper published in the City of Caldwell, Idaho, in one issue
thereof published on February 26, 1972.

day of February, 1972.
