BY COUNCILMAN BANX8 AN ORDINANCE DETERMINING THAT CERTAIN LAND IS CONTIGUOUS TO THE CITY OF CALDWELL, STATE OF IDAHO, AND DECLARING SAID LAND, BY PROPER LEGAL DESCRIPTION THEREOF, TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL: Section 1. That request by the owner of the hereinafter described land having heretofore been made to the Council in writing for the annexation of said land by the City of Caldwell, said land being contiguous to the City of Caldwell, Canyon County, State of Idaho, and the Council having consented thereto; Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell that the tract of land herein described by proper legal description is hereby declared to be a part of the City of Caldwell, Canyon County, State of Idaho; Section 3. That the full and complete legal description of the tract of land herein declared to be a part of the City of Caldwell, Idaho, as hereinabove set forth, is particularly set forth as follows: Commencing at the Southwest corner of the Southeast Quarter of the Northeast Quarter of Section 33, Township 4 North, Range 3 West of the Boise Meridian; thence North 0 °03 West, along the West boundary of the said Southeast Quarter of the Northeast Quarter, which boundary is also the center line of a street presently known as South Kimball Avenue, a distance of 661.40 feet to the Southwest corner of the Northwest Quarter of the Southeast Quarter of the Northeast Quarter, which point is the TRUE POINT OF BEGINNING; thence continuing North 0 ° 03'00" West, along the West boundary of the said Northwest Quarter of the Southeast Quarter of the Northeast Quarter, a distance of 430.00 feet; thence North 89 °SS'40" East, parallel with the South boundary of the said Northwest Quarter of the Southeast Quarter of the Northeast Quarter, a distance of 662.23 feet to a point on the East boundary of the said Northwest Quarter of the Southeast Quarter of the Northeast Quarter; thence South 0 °06 East, along the East boundary of the said Northwest Quarter of the South- east Quarter of the Northeast Quarter, a distance of 430.00 feet to the Southeast corner of the said Northwest Quarter of the Southeast Quarter of the Northeast Quarter; thence South 89 °55 West along the South boundary of the said Northwest Quarter of. the _;South- east Quarter of the Northeast Quarter, a distance-of 662.70 feet to the TRUE POINT OF BEGINNING. Section 4. All ordinances, resolutions, orders, or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section S. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. Section 6. All of the lands described in said ordinance shall be subject to taxation as other property and persons within the corporate limits of the City of Caldwell, Canyon County, Idaho, upon filing of a certified copy of this ordinance with the County Recorder of Canyon County, Idaho.
