ORDINANCE NO. 12:33 BY COUNCILMAN DAKAN AN ORDINANCE TO AMEND TITLE 11, CHAPTER 13, OF THE CITY CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Section 11 -13 -4 of Title 11, Chapter 13 of the City Code of the City of Caldwell, be amended to read as follows: 11 -13 -4: PARKING METERS: The Chief of Police is hereby authorized and directed to provide for the installation, regulation, control, supervision, opera- tion and use of parking meters within such parking meter zone. Such parking meters shall be placed on the curb or sidewalk immediately adjacent to the parking space hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter shall be so equipped, designed and constructed that upon deposit therein of United States coin in the following denominations, said meter shall visibly indicate that a vehicle may occupy a space adjacent to said parking meter for the following periods of time after the deposit of any such coin: DENOMINATION OF COIN: PARKING PERIOD: One Cent For each 12 minutes Five Cents or one nickel For 60 minutes Ten Cents or one dime For 2 hours - . 0 . Following resolution of the Council of the City, the Chief of Police may designate a parking meter zone in which shall be installed parking meters so equipped that in addition to the foregoing, upon deposit therein of one nickel, it shall indicate that a vehicle may occupy the space adjacent thereto for a period of two (2) hours after deposit of said one nickel, and on designated lots one (1) dime for a period of four (4) hours after deposit of said dime. Upon the expiration of such respective periods of time, a colored sign or signal shall become visible in each parking meter, which, when visible, shall indicate that the parking time for such space has expired. It shall be unlawful for any person to cause, permit, allow or suffer any vehicle to be parked dur- ing operation hours in a space adjacent to a parking meter while the colored signal or sign of the parking meter provided for that space is visible unless said vehicle has been issued a special parking permit. Section 2. That Section 11 -13 -7 of Title 11, Chapter 13 of the City Code of the City of Caldwell, be amended to read as follows: 11 -13 -7: DENOMINATION OF COIN: It shall be unlawful and a violation of the provisions of this Chapter for any person to deposit or insert, or cause to be deposited or inserted, in any parking meter, anything whatsoever except a lawful coin as designated by said meter. Section 3. That Section 11 -13 -9 of Title 11, Chapter 13 of the City Code of the City of Caldwell, be amended to read as follows: 11 -13 -9: POLICE TO ENFORCE: It shall be the duty of each police officer designated as Meter Officer or Meter Maid observing a violation of the provisions of Section 11 -13 -4 or 11 -13 -6 of this Chapter, to leave at or upon such a vehicle a notice that the vehicle has been parked in violation of the provisions of this Chapter; that said notice shall bear the date and hour of leaving the same at or upon such vehicle. The notice above mentioned shall be made and numbered in duplicate and it shall be the duty of each police officer to file one (1) copy of such notice with the Police Department after having placed a copy of such notice upon or at such vehicle that was parked in violation. It shall be the duty of such police officer to leave at or upon such vehicle a separate notice for each hour, or fraction thereof, that such vehicle remains parked in violation of the provisions of Section 11 -13 -4 and /or Section 11 -13 -6. Each owner or operator may, within twenty -four (24) hours of the time of such notice, pay to the Police Department as a penalty for, and in full satis- faction of such violation, the amount of twenty -five cents (25�) for each hour or fraction thereof, that such vehicle was parked in violation of the provisions of Section 11 -13 -4. The notice shall instruct the owner or operator of such vehicle to deposit said notice in any of the red courtesy collection boxes attached to the meter posts or bring said notice to the Police Department. - *AV - • 0 The failure of such owner or operator to return or make such payment to the Police Department within said twenty -four (24) hours shall render such owner or operator subject to the fine provided by Section 11 -13 -10 of this Chapter. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED BY THE COUNCIL of the City of Caldwell this 7th day of September, 1971.
