HomeMy WebLinkAboutORD 1231• Fj BILL NO. _23 ORDINANCE NO. 1231 BY COUNCILMAN Davenport AN ORDINANCE CALLING AN ELECTION FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF CALDWELL, IDAHO, THE PROPOSITION OF THE ISSUANCE OF $377,250.00 GENERAL OBLIGATION LIBRARY BONDS OF SAID CITY, AND PROVIDING FOR THE ISSUANCE OF SUCH BONDS IN THE EVENT THEY ARE VOTED AT SUCH ELECTION. WHEREAS, The construction and furnishing of an adequate public building for use as a municipal public library is considered by the City Council of the City of Caldwell to be necessary and essential to the health and well -being of the inhabitants of said city; and WHEREAS, Said city does not have funds available to pay the cost of the foregoing and has determined it advisable to finance such cost through the issuance of the bonds of the city pursuant to the provisions of Chapter 10 of Title 50 of the Idaho Code, and in order to do so desires to provide for the holding of the election required by said chapter; NOW, THEREFORE, Be it ordained by the Mayor and Council of the City of Caldwell, Canyon County, Idaho, as follows: bond Section 1. That a special /election is hereby called to be held in the City of Caldwell on November 2, 1971, for the purpose of submitting to the qualified electors of said city the proposition set forth in the form of ballot appearing in Sec- tion 3 hereof. Section 2. That the polls at said election shall open at the hour of 12:00 o'clock noon and remain open continuously until the hour of 8:00 o'clock p.m. and then close. Said election shall be held at the voting places specified in the form of notice of election set out in Section 4 hereof. Section 3. That all persons who at the time of the election are qualified electors of the city and properly registered and possessing the qualifications of residents, shall be qualified to vote at said election, and that the ballots to be used at said election shall be in substantially the follow- ing form: OFFICIAL BALLOT SPECIAL BOND ELECTION CITY OF CALDWELL CANYON COUNTY STATE OF IDAHO NOVEMBER 2, 1971 INSTRUCTIONS TO VOTERS: To vote on the following question place a cross CX) in the square to the right of "In favor of issuing bonds to the amount of $377,250.00 for the purpose provided by Ordinance No. 1231 or "Against issuing bonds to the amount of $377,250.00 or t e purpose provided by Ordinance Number 1231 according to the way you desire to vote on the question. All distinguishing marks are forbidden and make the ballot void. If you, by mistake or accident, mark, tear, deface or otherwise mutilate this ballot, return it to the election judges and obtain another ballot. QUESTION: Shall the City of Caldwell, Idaho, issue and sell its negotiable coupon general obligation bonds to the amount of $377,250.00, for the purpose of providing funds with which to construct a new building and furnish said building for use as a municipal public library, said building to be con- structed and furnished at its present site, which is 1101 Cleveland Boulevard, Caldwell, Idaho, as is more fully provided in Ordinance Number 1231 adopted on August 16, 1971? IN FAVOR OF ISSUING BONDS TO THE AMOUNT OF $377,250.00 FOR THE PURPOSE PROVIDED BY ORDINANCE NUMBER 1P3l AGAINST ISSUING BONDS TO THE AMOUNT OF $377,250.00 FOR THE PURPOSE PROVIDED BY ORDINANCE NUMBER 3231 Section 4. That notice of said election shall be given by the City Clerk by publication of the following notice in The News- Tribune, a newspaper published and having general circula- tion in the City of Caldwell, once a week on the same day of 1 1 five successive weeks, the first of which publications shall be not less than thirty (30) days prior to the date fixed for the holding of said election. NOTICE OF SPECIAL BOND ELECTION Pursuant to the laws of the State of Idaho and Ordinance Number 1231 of the City of Caldwell, County of Canyon, State of Idaho, notice is hereby given that a special bond election will be held in said City on Nov- ember 2, 1971, beginning at the hour of 12:00 o'clock noon and closing at the hour of 8:00 o'clock p.m. of said day, for the purpose of taking a vote upon the following ques- tion, to wit: QUESTION: Shall the City of Caldwell, Idaho, issue and sell its negotiable coupon general obligation bonds to the amount of $377,250.00, for the purpose of providing funds with which to construct a new building and furnish said building for use as a municipal public library, said building to be con - structed and furnished at its present site, which is 1101 Cleveland Boulevard, Caldwell, Idaho, as is more fully provided in Ordinance Number 1231 adopted on August 16, 1971? Said election will be held at the following voting places: PRECINCT VOTING PLACE First Precinct The County Courthouse between 11th and 12th Avenues on Albany Street Second Precinct Jewett Auditorium, College of Idaho Campus Third Precinct The Methodist Church at 824 East Logan Street Fourth Precinct The City Hall at 704 Blaine Street Notice is further given that only qualified electors of said City who are registered as provided by law are entitled to vote at said election. No qualified elector who is duly registered as a voter at the last preceding general municipal 0 • election shall be required to. reregister so long as he remains, or has remained, continuously after such registration, a duly qualified elector of the City of Caldwell, but those electors who have failed or neglected heretofore to vote at any general biennial city or county election for the past eight (8) years must reregister. Sayler , Deputy Registrar 1510 Ellis Avenue Walter Fry, County Clerk Canyon County Court House Persons may register on each day at any time during the office hours of said City Clerk or Deputy Registrars or Canyon County Clerk beginning with the day that the notice of election is given and continuing until and including the Saturday next preceding the election for the City Clerk and County Clerk. However, registration with Deputy Registrars in precincts shall cease ten (10) days before the day of election. On Saturday next preceding the election, persons may register between the hours of 9:00 o'clock a.m. and 8:00 o'clock p.m. at Caldwell City Hall. The voting at said election shall be by ballot. The ballots to be supplied the voters for their use at said election shall be in the form set forth in Ordinance Number 1231 0 If at said bond election two- thirds of the qualified electors of the city voting at such election assent to the issuing of such bonds and the incurring of the indebtedness thereby created for the purpose of providing funds with which to construct a new building and furnish said building for use as a municipal public library, said building to be constructed and, furnished at its present site, which is 1101 Cleveland Boulevard, Caldwell, Idaho, such bonds shall be issued for such voted purpose in the manner provided by the Municipal Bond Law of Idaho. Said General Obligation Library Bonds shall mature over a period commencing at the expiration of one year and ending thirty years from their date and shall bear interest at a rate or rates not in excess of 6% per annum and shall be payable in accordance with the provisions of Section 57 -222, Idaho Code, and the Municipal Bond Law of Idaho. That if at said election two - thirds of the qualified electors of the city voting thereat assent to the issuance of said General Obligation Library Bonds, the bonds of the city shall be issued as hereinabove provided and shall mature over a period commencing at the expiration of one year from their date and ending thirty years from their date and bear interest at a rate or rates not in excess of six percent (6 %) per annum, and shall be payable in accordance with the provisions of Section 57 -222, Idaho Code, and the Municipal Bond Law of I daho . Section 6. That said bonds shall be issued if carried as aforesaid, and payment shall be made through the levy of taxes on all taxable property in the City of Caldwell, beginning with the year 1971 and continuing until principal and interest shall have been fully paid, in such amounts and at such rates as are necessary to assure the prompt payment of such principal and interest, and it is hereby ordered that such taxes shall be levied annually at the time and in the manner the general taxes for said city are levied in each such year, in addition to all other authorized taxes and assessments. Section 8. That all ordinances or parts thereof in conflict herewith are, to the extent of such conflict, hereby repealed, and that this ordinance shall be published in one issue of the News- Tribune, the official journal of said city, and shall take effect and be in full force immediately upon its passage, approval and publication.
