HomeMy WebLinkAboutORD 1229BILL NO. 21 ORDINANCE NO. 1229 BY COUNCILMAN Ae C TUSKFY AN ORDINANCE GIVING NOTICE TO CITIZENS AND OWNERS OF PROPERTY IN CANYON COUNTY, STATE OF IDAHO, WITHIN ONE (1) MILE OF THE BOUNDARIES OF THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION HAS BEEN PRESENTED FOR THE VACATION OF A PART OF GINGER LANE IN RIO VISTA ACRES ADDITION TO CALDWELL, CANYON COUNTY, IDAHO. BE IT ORDAINED AND ESTABLISHED By the Mayor and the Council of the City of Caldwell, Idaho: Section 1. That an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, pursu- ant to the provisions of 50 -1306 (a) Idaho Code for the passage and approval of an ordinance vacating that part of Ginger Lane in Rio Vista Acres Addition to Caldwell, Canyon County, Idaho, described as follows, to wit: A part of Rio Vista Acres Addition to Caldwell, Canyon County, Idaho in Government Lot 4, Section 10, Town- ship 4 North, Range 3 West of the Boise Meridian, more particularly described, to wit: BEGINNING at the Northwest corner of Lot 9, Block 4 of said Rio Vista Acres Addition; thence North 0 40' West, 40 feet; thence North 89 20' East, 150 feet; thence South 0 40' East, 40 feet to the Northeast corner of the said Lot 9; thence South 89 20' West, 150 feet along the Northerly line of the said Lot 9 to the POINT OF BEGINNING; This tract is subject to a utility, irrigation and drainage easement to be retained along the Easterly 10 feet. ALSO: BEGINNING at the Northeast corner of Lot 7, Block 3 of said Rio Vista Acres Addition; thence South 89 20' West, 130 feet along the Northerly line of the said Lot 7 to the Northwest corner thereof; thence North 0 40' West, 40 feet; thence North 89° 20' East, 130 feet; thence South 0 40' East, 40 feet to the POINT OF BEGINNING; This tract is subject to a utility, irrigation and drainage easement to be retained along the Westerly 10 feet. Section 2. That said application will be considered under a suspension of the requirements that an ordinance be read on three different days at a meeting of the Council of the City of Caldwell, Idaho, to be held on the 7th day of September, 1971, at the hour of eight o'clock p.m., Mountain Daylight Time, at the Council Chambers in the City Hall in the City of Caldwell; when and where, or prior to which date any citizen or any owner of property may file with the Clerk of the City of Caldwell an objection to the vacation of said property and any objections so filed will be considered by the Council of the City of Caldwell at said meeting. Section 3. Notice of the foregoing will be given to all property owners within three hundred (300) feet of the boun- daries of the area described in this ordinance; said notice shall be given by certified mail with return receipt requested at least ten (10) days prior to the date of said public hearing, and in addition thereto notice shall be given by publishing this ordinance in The News - Tribune, a newspaper published in the City of Caldwell, Idaho, in two (2) issues thereof published on the 7th day of August, 1971 and on the 14th day of August, 1971, the last publication of which shall be not less than seven days prior to the date of said hearing.
