ORDINANCE NO. 1226
BY COUNCILMAN KEYS
AN ORDINANCE TO AMEND TITLE 6, CHAPTER 3, SECTION 2, OF THE
CITY CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That Title 6, Chapter 3, Section 2(B) of
the City Code of Caldwell, Canyon County, Idaho, is amended to
read as follows, to wit:
(B) Retail shops: Retail shops if built in a style
conforming with their surroundings by special permit
of the Board of Adjustment after a public hearing,
and a showing that such action will not cause damage
and will be in accord with the general purpose of
this Title and provided that before a permit is
issued by the Board of Adjustment there shall be on
file in the office of the Building Inspector, the writ-
ten consent of the owners of seventy -five percent
75%) of the area of all the property within a radius
of three hundred feet (300 of any part of the premises
whereupon such retail shop is to be erected or occupied.
Section 2. That Title 6, Chapter 3, Section 2(D) of
the City Code of Caldwell, Canyon County, State of Idaho, is
amended to read as follows, to wit:
(D) Hospitals: Philanthropic institutions, hospitals,
professional offices and sanitariums by special permit
of the Board of Adjustment after a public hearing.
Section 3. This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
