An Ordinance providing for the organization and government of a Fire
Department of the City of Caldwell, fixing the compensation of its
officers and members, prohibiting interference with firemen or fire
apparatus in going to, at and returning from fires, providing pen-
alties, and repealing Ordinance No. 19, entitled, "An Ordinance
iroviding for the organization and government of a Fire Wartrient
of the City of Caldwell," passed and approved April 13, 1901.

Be it Oddained by the Mayor and Council of the City of Caldwell:
Section 1. The fire department of the City of Caldwell shall con-
sist of a hose company and a hook and ladder company, and such other
companies as may be organized, subject to the provisions of this ordin-
ance.
Section 2. The number of active Members of the several companies
shall be as follows:
Hook and Ladder companies: Not teas than eight and not more than
, fifteen.
Hose companies: Not less than five, and not more than ten.
No company shall be admitted into the department which has not at
the time of its admission uponits roll of active members at last the
minimurr, number as required by this section. If at any time the active
members of any corripany shall be kcis a than- e minimum number aforesaid,
it shall be the duty of the foreman and clerk to certify the fact to th
chief, and the chief shall report the same to the city council, and the
company shall be suspended from a'll privileges in the department during
the time such deficiency exists.
Sec. 3. The officers of the department shall be one chief and one
assistant chief, each of whom shall be active members of one of the
regularly organized and admitted # ** companies -f the department.
They shall be elected annually at a ##JbWA## special meeting of the
department on the third Yonday of April by the active members of the
department in good standing, which meeting shall be for that purpose.

Every active member in good standing shall be entitled to vote for chief
and assistant chief.
Sec. 4. It shall be the duty of the chief to certify the result of
the election of chief and assistLant chieg to the City Council.. And the
council shall at the first regular meeting after said election direct
the city clerk to issue certificates of election to the persons elected
upon their filing with the city clerk an oath to support the constitu-
tion and laws of the State of Idaho, and the ordinances of the City of
Caldwell, and to faithfully performs the duties of their respective of-
fices according to the best of their ability. Upon the issuance of
said certificates, the officers shall be entitled to enter upon the du-
ties of their respective offices.
Sec. 5. The chief shall preside at the regular meetings of the de-
partment and preserve order and decorum. The duty of extinguishing_
fires and of protecting life and property in case of fire, within the
city, shall be entrusted to the chief. The chief shall have sole and
entire command at fires, fire alarms and drills over all officers and
members of the department, and all apparatus and appurtenances belonging
to the same and he shall take all measures which he shall deem exped-
ient for the extinguishment of fires, protection of property, preserva-
tion of order, and 'observance of the laws of the State, ordinances of
the city, and rules and regulations of the city council.
It shall be the duty of the chief to examine into the condition of
all houses, apparatus and appurtenances belonging to the department and
to inspect all fire companies.
The chief may suspend or dismiss any officer or member of the de-
partment who is addicted to the habitual use of intoxicants, or who 4
shall use profane, immoral, or indecent language, or who shall be in-
toxicated in or about any department halls, or at any meeting, or fire,
or drill.
It shall be the duty of the chief to superintend the companies corn-
prising the department, to see that they keep the apparatus and machin-
ery under their control clean and in good order, and ready at all times

for active duty, and if at any time he finds any officer or member dere-

of the department.
The chief shall have absolute control of the fire department at all
times when it is on active duty, and shall direct or cause to be direct-
ed all movements of the several companies. His orders shall at all
times be given to the officers in command of the several companies.
The chief shall see that each company has at least one thorough drill
each month`'and in case of inattention or insubordination of any member,
Its may suspend or expel him, subject to the approval of the department.
In case of insubordination of a company he may suspend or disband
the same, subject to the approval of the city council.
The chief shall enroll the requisite number of persons fit for duty
in such department into new companies, call a meeting of the same, and
said company shall organize pursuant to the provisions of this ordin-
anee.
During the last week in December and June of each year, he shall
take a complete inventory of the tools, apparatus, and furniture of
each company, noting the number¢ or amount of each and its
condition, and the number of active members, the number of drills had,
the number and dates of alarms and fires attended, and make complete
reports to the city council at the regular meetings in January and July
of each year„ At the same time he shall make such requisitions for
equipments and supplies as he may deem necessary for the efficiency of
the service.
After each fire, the chief shall make prompt and thorough investiga-
tion of the cause of such fire, the amount of loss and insurance, time
of breaking out, description of building and all necess ary particulars,
and record the same in a record book kept for that purpose in the de-
partment. And lie shall embody a summary of the same in his semi - annual
report, together with the number of fire alarms and location and number
of fires scgvrring during that time.
The chief shall at the first reguh r meeting after his confirmation
appoint a clerk and a treasurer for the department, which appointments
shall hold for a year or until their success ors are appointed.
Sec. 6. It shall be the duty of the assistant Chief to attend the
chief and assist him in the performance of his duties. In the absence
of the chief, he shall perform the duties of that o fficer.
See. 7. In case of vacancy in the office of chief or assistant
chief an election shall be had at the next regular meeting to fill the
unexpired tern, and such election shall be conducted in all respects as
the regular election.
See. 6. When on active duty the chief and assistant chief and such
members of the department as the chief shall designate shall each be in-
vested with the authority of police officers of the City of Caldwell.
Sec. 9. The officers of the several companies shall be one fore-
man, one assistant foreman, and one clerk. They shall be elected at
the first drill meeting in January and July 10 in each year. The
foreman of I( each company shall, and it is made his duty to appoint
his assistants, subject to the approval of the chief.
See. 10. Any able bodied citizen of Caldwell over 18 and under 40
years of age may become a member of the department by being elected by
the active members thereof. In no case shall a negative vote of less
than three reject any applicant for membership.
Sec. 11. The chief shall receive as compensation the sum of $2.00
per month, after his report has been approvedby the city council; the
assistant chief shall receive $1.50 per month; the foreman of each com-
pany shall receive 75 cents for each drill, and each member in good
standing shall receive as compensation at the end of each half year,
the sum of 50 cents for each drill attended, paid drills not t0 exceed
twoeach month, and $1.00 for each fire attended. In case of serious
fire, after three hours, each member shall receive 35 cents per hour.
Provided, No member shall receive any compensation until he shall have
been a member of the department six months, and no member shall be con-
sidered in good standing who is absent from the drills of the company
of which he is a member for two months, unless excused on account of
sickness by the foreman. In addition, each member shall be exempt
from road poll tax.
Sec. 12. Any member of the department who has faithfully served

the city as fireman for fifteen years shall become at his option a vet-
eran fireman, and shall be entitled to all the exemptions, but none of
compensation of active firemen. He shall be furnished by the city
with a certificate and badge showing that he is a veteran fireman.
See. 13. No liability incurred by the fire department or any of
the companies thereof, shall be a X charge against the city unless
authorized by the city council before the same is incurred.
Sec. 14. If any member of any company of the department be injured
as a result of his fighting fires within the city, the City of Caldwell
shall pay a reasonable doctor's bill not to exceed $50.00, and should
any member die as a result of fighting fire in this city, the City of
Caldwell shall pay the funeral wxpenses, not to exceed $75.00.
Sec. 15. The City of Caldwell shall pay all the reasonable ex-
penses of the department such as stationary and incidental expenses.
See. 16. Whenever an alarm of fire is given, all persons occupying
the public streets with. wagons, teams or vehicles of any description,
between the fire depw tment station and the location of the fire, shall
yield the right of way on such streets to the fire companies and the
movable apparatus of the department when going to such fire. And any
person or persons who shall during; any fire or drill interfere with or
obstruct the work of the .firemen, or handle any of the implements or
apparatus of the department except upon the invitation of the chief or
by his permission, shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in any sum not exceeding one hundred
dollars.
See. 17. prompt, quiet obedience must be given to alllorders it
from officers, and no disputing shall be allowed while on duty. In
going to, while at, or returning from fires, all unnecessary noise shall
be avoided, and a civil demeanor shall always be preserved to citizens,
but no orders shall be taken from them.

well, active members of the fife department or working under #"
vitation or permission of the chief, who shall occupy the grounds within'
60 feet of any fire or impede the work of the firemen or blockade the
way to, from or around any fire, shall be deemed guilty of a misde-
meanor, and shall upon conviction thereof be fined any sum not
exceeding one hundred dollars.
Sec. 19. It shall be the duty of the regular policemen and members
of the fire depw - tment designated as police officers by the chief to see
that Sections 16 and 1$ of this ordinance are complied with.
Sec. 20. Ordinance No. 19, entitled, "An ordinance providing for
the organization and government of #1# 06#60M a fire department of the
City of Caldwell," passed and approved April 13, 1901, and all ordinanees
and parts of ordinances in conflict with this ordinance are hereby re-
pealed.
Sec. 21. Whereas an emergency exists this ordinance shall be in
force and take effect from and after its passage a prcr,!al.
