AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF
PROPERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION
HAS BEEN PRESENTED FOR THE VACATION OF LOCUST STREET AT THE
INTERSECTION OF CLEVELAND BOULEVARD WITHIN THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO. .
BE IT ORDAINED AND ESTABLISHED By the Mayor and the
Council of the City of Caldwell, Idaho:
Section 1. That an application has been presented to
the Mayor and the Council of the City of Caldwell, Idaho, for
the passage and approval of an ordinance vacating that part of
Locust Street at the intersection of Cleveland Boulevard within
the City of Caldwell, Canyon County, Idaho, the said portion
to be vacated is described as follows, to wit:
COMMENCING at the Northwest corner of the Northeast
Quarter of Section 35, Township 4 North, Range 3 West
of the Boise Meridian; thence South 0 11' 20" East,
along the West boundary of the said Northeast Quarter
of Section 35, 654.85 feet to the True Point of
Beginning;
Thence North 89 29' 45" East, 114.56 feet; thence
South 43° 07' 30" West, 82.81 feet; thence South
89 29' 45" West, 8.29 feet to a point in the North-
easterly boundary of Cleveland Boulevard; thence
North 46 52' 30" West, along the Northeasterly
boundary of Cleveland Boulevard, 68.02 feet; thence
North 0 11' 20" West, 13.04 feet to the TRUE POINT
OF BEGINNING.
Section 2. That said application will be considered
under a suspension of the requirements that an ordinance be read
on three different days at a meeting of the Council of the
City of Caldwell, Idaho, to be held on the 3rd day of May, 1971,
at the hour of eight o'clock p.m., Mountain Daylight Time, at
the Council Chambers in the City Hall in the City of Caldwell;
when and where, or prior to which date any citizen of the City
of Caldwell or any owner of property in the City of Caldwell
may file with the Clerk of the City cf Caldwell any claim for
damages which any such citizen or owner of property may sustain
by reason of the vacation of the said property and all claims
for damages so filed will be considered and ascertained by the
Council of the City of Caldwell, at said meeting.
Section 3. Notice of the foregoing will be given to
all citizens of, and owners of property in the City of Cald-
well, Idaho, by publication of this ordinance in The News- Tribune,
a newspaper published in the City of Caldwell, Idaho, in one
issue thereof published on April 24, 1971.
