ORDINANCE NO. 1206
BY COUNCILMAN KEYS
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF
PROPERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION
HAS BEEN PRESENTED FOR THE VACATION OF A PORTION OF SIXTH AVENUE
WITHIN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO.
BE IT ORDAINED AND ESTABLISHED By the Mayor and the
Council of the City of Caldwell, Idaho:
Section 1. That an application has been presented to
the Mayor and the Council of the City of Caldwell, Idaho, for the
passage and approval of an ordinance vacating a portion of Sixth
Avenue within the City of Caldwell, Canyon County, Idaho, the
said portion to be vacated is described as follows, to wit:
BEGINNING at the South corner of Lot 28 of the First
Amended Plat of Blocks 58 and 59 of Golden Gate Addition
to the City of Caldwell, Idaho, as of record and on file
in the office of the Recorder of Canyon County, Idaho;
thence Northeasterly along the Southeasterly boundary
of said Lot 28, 120.00 feet, to the East corner of said
Lot 28; thence Southeasterly, 80.00 feet to a point in
the Northwesterly boundary of Lot 29 of said First
Amended Plat, which is 8.00 feet Southwesterly from
the North corner of said Lot 29; thence Southwesterly
along the Northwesterly boundary of said Lot 29, 120.00
feet to the West corner of said Lot 29; thence North-
westerly 80.00 feet, to the POINT OF BEGINNING.
ALSO:
BEGINNING at the South corner of Lot 12 of the First
Amended Plat of Blocks 58 and 59 of Golden Gate Addi-
tion to the City of Caldwell, Idaho as of record and on
file in the office of the Recorder of Canyon County,
Idaho; thence Northeasterly along the Southeasterly
boundary of said Lot 12, 110.00 feet to a point which
is 10.00 feet Southwesterly of the East corner of said
Lot 12; thence Southeasterly 80.00 feet to a point in
the Northwesterly boundary of Lot 13 of said First
Amended Plat, which is 0.57 feet Southwesterly from the
North corner of said Lot 13; thence Southwesterly
along the Northwesterly boundary of said Lot 13, 110.00
feet to a point 8.00 feet Northeasterly from the West
corner of said Lot 13; thence Northwesterly 80.00 feet,
to the TRUE POINT OF BEGINNING. --

Section 2. That said application will be considered
under a suspension of the- requirments that an ordinance be read
on three different days at a meeting of the Council of the City
of Caldwell, Idaho, to be held on the 18th day of January, 1971,
at the hour of eight o'clock p.m. at the Council Chambers in the
City Hall in the City of Caldwell; when and where, or prior to
which date any citizen of the City of Caldwell or any owner of
property in the City of Caldwell may file with the Clerk of the
City of Caldwell any claim for damages which any such citizen or
owner of property may sustain by reason of the vacation of the
said property and all claims for damages so filed will be con -
sidered and ascertained by the Council of the City of Caldwell
at said meeting.
Section 3. Notice of the foregoing will be given to
all citizens of, and owners of property in the City of Caldwell,
Idaho, by publication of this ordinance in The News - Tribune, a
newspaper published in the City of Caldwell, Idaho, in one issue
thereof published on January 9, 1971.
PASSED By the Council of the City of Caldwell this 5th
Day of January, 1971.
APPROVED By the Mayor of the City of Caldwell this
5th day of January, 1971.
