AN ORDINANCE AMENDING SECTION 6 - - PARAGRAPH (I), CHAPTER 3,
TITLE VI OF THE CITY CODE OF CALDWELL, IDAHO, PROVIDING THAT
DWELLING OR APARTMENT HOUSES WITH FOUR OR MORE FAMILY UNITS
SHALL NOT BE CONSTRUCTED IN THE "AB" RESIDENCE ZONE WITHOUT
SPECIAL PERMIT OF THE BOARD OF ADJUSTMENT AFTER A PUBLIC HEARING,
WITH THE FURTHER PROVISION THAT BEFORE THE ISSUANCE OF SAID SPECIAL
PERMIT AND PRIOR TO THE PUBLIC HEARING THERE SHALL BE ON FILE IN
THE OFFICE OF THE BUILDING INSPECTOR THE WRITTEN CONSENT OF THE
PERSONS OWNING SIXTY PERCENT (60 %) OF THE AREA OF ALL PROPERTY
WITHIN A RADIUS OF 300 FEET OF ANY PART OF THE PREMISES UPON WHICH
SAID DWELLING OR APARTMENT HOUSE OF MORE THAN THREE FAMILY UNITS
IS TO BE LOCATED, AND SUCH DWELLING OR APARTMENT HOUSES SHALL PRO-
VIDE NOT LESS THAN 600 SQUARE FEET OF LIVING SPACE FOR EACH FAMILY
UNIT; ADDING TO SAID SECTION 6 - - OF CHAPTER 3, TITLE VI OF THE
CITY CODE PARAGRAPH (J) LIMITING THE HEIGHTH OF DWELLING OR APART-
MENT HOUSES OF THREE OR LESS FAMILY UNITS TO TWO STORIES; AND
PROVIDING FOR THIS ORDINANCE TO BE IN FORCE AND EFFECT FROM AND
AFTER ITS APPROVAL, PASSAGE AND PUBLICATION, AND RE °EALING ALL
ORDINANCES IN CONFLICT THEREWITH.

Be it ordained by the Mayor and Council of the City of

Caldwell, Idaho:
Section 1. That Chapter 3, Title VI, Section 6 - -
17 paragraph (I) of the City Code of Caldwell, Idaho, is hereby amend -
18 ed to read as follows:
"(I) Dwelling or apartment houses containing four (4) or
more family units: Dwelling or apartment houses with four (4) or
more family units shall not be constructed in the "AB" Residence
Zone without special permit of the Board of Adjustment after a
public hearing, with the further provision that before the issuance
of said special permit and prior to the public hearing there shall
be on file in the office of the Building Inspector the written
consent of the persons owning sixty percent (60 %) of the area of
all property within a radius of 300 feet of any part of the pre-
mises upon which said dwelling or apartment houses of more than
three family units is to be located, and such dwelling or apart-
ment houses shall provide not less than 600 square feet of living

Section 2. That Chapter 3, Title VI, Section 6 -3 -2 of

the City Code of Caldwell, Idaho, is hereby amended by adding para-
graph (J) thereto, to read as follows:
"(J) Limitation of heighth of dwelling or apartment
houses containing three (3) or less family units: Dwelling or
apartment houses with three (3) or less family units shall not
exceed two (2) stories in heighth."
Section 3. All ordinances, resolutions, orders, or
parts therewith, in conflict herewith are hereby repealed, res-
cinded and annulled.
Section 4. This ordinance shall be in full force and
effect fram and after its approval, passage and publication, as
required by law.
