AN ORDINANCE AMENDING SECTION 6 -3 -3 , PARAGRAPH (A) OF CHAPTER 3,
TITLE VI, ADDING TO PARAGRAPH (A) THAT MULTIPLE DWELLINGS AND APART-
MENT HOUSES SHALL HAVE NOT LESS THAN 3000 SQUARE FEET OF LAND FOR
EACH FAMILY UNIT EXCEPT VARIANCES TO THIS REQUIREMENT MAY BE GRANTED
BY THE BOARD OF ADJUSTMENT AND SUBJECT TO RIGHT OF APPEAL TO THE CITY
COUNCIL, AND PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT
WITH THIS ORDINANCE AND PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT
FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION.
BE IT ORDAINED By the Mayor and Council of the City of
Caldwell, Idaho:
Section l.That Section 6 -3 -3, Paragraph (A) of Chapter 3,
Title VI, of the City Code of the City of Caldwell, Idaho, be amended
by adding thereto paragraph (A) to read as follows:
"(A) Setback: In "AB" Residence Zone every building here
after erected or structurally altered shall have a setback of at
a
least twenty feet (20�) from the street property line on which the
building fronts, provided, however, that in each block in which fifty
per cent (50 %) or more of the lots on the same side of the street
shall have been built upon in conformity with a fairly even and deter
minable front building line more or less than twenty feet (20') from
the street line, all buildings thereafter erected, established or
rebuilt shall be in conformity with said front building line deter-
mined by buildings already erected on fifty per cent (50%) of the lot
Where a building line has been established on each of intersecting
streets, structures erected on corner lots shall conform to both es-
tablished building lines.
In determining whether or not a front building line has
been determined and established the fair intents and purposes shall
be considered and minor irregularities ignored. As fast as deter-
mined said setbacks shall be registered upon the book of plats in the
office of the Building Official and said plat shall be the guide in
future determination.
No part of the building except unenclosed and unroofed

porches, not to exceed four feet (4 above the established grade,
shall extend in front of the setback line.
Multiple dwellings and apartment houses shall have not les
than 3000 square feet of land for each family unit except variances
to this requirement may be granted by the Board of Adjustment and
subject to right of appeal to the City Council."
Section 2. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 3. That this ordinance shall be in force and
effect from and after its passage and publication.
