AN ORDINANCE ADDING SECTIONS 11 - 4 - 6, 11 - 4 - AND 11 - - TO CHAPTER 4,
TITLE XI OF THE CODE OF THE CITY OF CALDWELL, IDAHO, REGULATING THE
OPERATION OF MOTOR VEHICLES WHEN APPROACHING OR ENTERING AN INTER-
SECTION, WHEN TURNING LEFT AT AN INTERSECTION, AND WHEN TO STOP OR
YIELD THE RIGHT OF WAY AT AN INTERSECTION AND MAKING IT UNLAWFUL TO
VIOLATE SAID REGULATIONS: AND PROVIDING FOR THE REPEAL OF ALL ORDI-
NANCES IN CONFLICT WITH THIS ORDINANCE: AND PROVIDING FOR THIS ORDI-
NANCE TO BE IN FORCE AND IN EFFECT FROM AND AFTER ITS PASSAGE, APPROV
AL AND PUBLICATION.
BE IT ORDAINED By the Mayor and Council of the City of
Caldwell, Idaho:

11 Section 1. That it is hereby added to Title XI, Chapter
12 4, of the City Code of the City of Caldwell, Idaho, Section 11 -4 -6,
1 , 3 11 to read as follows:
"11 -4 -6: VEHICLES APPROACHING OR ENTERING INTERSECTION -
15 1(A) The driver of a vehicle approaching an intersection shall yield
16llthe right of way to a vehicle which has entered the intersection from
1711a different street or highway.
(B) When two vehicles enter an intersection from differ-
1911ent streets or highways at approximately the same time the driver of
the vehicle on the left shall yield the right of way to the vehicle
2111 on the right.
(C) The right of way rules declared in paragraphs (A) and
(B) are modified at through streets or highways and otherwise as set
forth in section 11 -4 -8 of this code."
Section 2. That it is hereby added to Title XI, Chapter
4, of the City Code of the City of Caldwell, Idaho, Section 11 -4 -7,
to read as follows:
11 11 - - VEHICLES TURNING LEFT AT INTERSECTION: The
driver of a vehicle within an intersection intending to turn to the
left shall yield the right of way to any vehicle approaching from the
opposite direction within 100 feet of the intersection.
Section 3• That it is hereby added to Title XI, Chapter 4,

of the City Code of the City of Caldwell, Idaho, Section 11 -4 -8, to
read as follows:
"11 -4 -8: VEHICLES ENTERING - STOP OR YIELD INTERSECTIONS:

- (A) Preferential right of way at an intersection may be indicated
by stop signs or yield signs as authorized in Title XI Chapter 5 of
this code.
7 (D) Except when directed to proceed by a police officer
8 or traffic - control signal, every driver of a vehicle approaching a
9 stop intersection indicated by a stop sign shall stop as required in
10 Title XI Chapter 5 of this code and after having stopped shall yield
11ithe right of way to any vehicle which has entered the intersection
12 from another roadway or which is approaching so closely on said road -
13 way as to constitute an immediate hazard, but said driver having so
14 yielded may proceed and the drivers of all other vehicles approach -
15 ing the intersection shall yield the right of way to the vehicle so
1R proceeding.
17 (C) The driver of a vehicle approaching a yield sign
18 shall in obedience to such sign slow down to a speed reasonable for
19 the existing conditions, or shall stop if necessary as provided in
20 Title XI Chapter 5 of this Code, and shall yield the right of way to
211 any pedestrian legally crossing the roadway on which he is driving,
22 and to any vehicle in the intersection or approaching on another road
23 way so closely as to constitute an immediate hazard. Said driver
24 having so yielded may proceed and the drivers of all other vehicles
approaching the intersection shall yield to the vehicle so proceed-
ing, provided, however, that if such driver is involved in a collis-
ion with a pedestrian in a crosswalk or a vehicle in the intersection
after driving past a yield sign without stopping, such collisions
shall be deemed prima face evidence of his failure to yield right of
way."
31 Section 4. It shall be unlawful for the driver of a motor
32 vehicle to fail to abide by the regulations set forth in Sections
11 -4 -6, 11 -4 -7 and 11 -4 -8, as hereinbefore set out in Sections 1, 2

and 3 of this ordinance.
Section 5. That all ordinance or parts of ordinances in
conflict herewith are hereby repealed.
Section 6. That this ordinance shall be in force and
effect from and after its passage, approval, and publication.
