ORDINANCE NO. 1168
BY COUNCILMAN HARRISON
AN ORDINANCE AMENDING SECTION 11 -6 -33 OF CHAPTER 6 OF TITLE XI OF THE
CITY CODE OF THE CITY OF CALDWELL, IDAHO, MAKING IT UNLAWFUL FOR ANY
RACE OR CONTEST OF SPEED AND THE LIKE ON ANY STREET, ROAD, ALLEY,
HIGHWAY OR PUBLIC RIGHT OF WAY IN THE CITY OF CALDWELL, IDAHO, AND
PROVIDING THE PENALTY THEREFORE; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PROVIDING FOR THIS
ORDINANCE TO TAKE EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND

Caldwell, Idaho:
Section 1. That Section 11 -6 -33 of Chapter 6 of Title XI
of the City Code of the City of Caldwell, Idaho, be amended to read
as follows:
11 11 -6 -33: RACING ON STREETS AND HIGHWAYS: (A) No person
1511shall drive any vehicle in any race, speed competition or contest,
drag race or acceleration contest, test of physical endurance, exhi-
1711bition of speed or acceleration, or for the purpose of making a
speed record, on any street, road, alley, highway or public right -of-
19l1way in the city, and no person shall in any manner participate in any
such race, competition, contest, test or exhibition.
(B) 'Drag Race' is defined as the operation of two or more
22 vehicles from a point side by side at accelerated speeds in a competi°
23 tive attempt to outdistance each other, or the operation of one or
24 more vehicles over a common selected course, from the same point to
25 the same point for the purpose of comparing the relative speeds or
26 power of acceleration of such vehicle or vehicles within a certain
27 distance or time limit.
(C) 'Racing' is defined as use of one or more vehicles in
an attempt to outgain, outdistance, or prevent another vehicle from
passing, to arrive at a given destination ahead of another vehicle
31 11or vehicles, or to test the physical stamina or endurance of drivers
over long distance driving routes.

1 (D) 'Penalty': Every person who is convicted of a viola -
2 tion of this Section shall be punished by imprisonment in the munici
3 pal jail for a period of not less than five (5) days nor more than
4 thirty (30) days, or by a fine of not less than $25.00 nor rmre than
5 $300.00, or both such fine and imprisonment, and on a second or sub -
6 sequent conviction shall be punished by imprisonment in the municipa
7 jail for a period of not less than ten (10) days nor more than thirt
g (30) days, or by a fine of not less than $50.00 nor more than $300.0
g or both such fine and imprisonment."
10 Section 2. That all ordinances or parts of ordinances in
11 conflict herewith are hereby repealed.
12 Section 3. That this ordinance shall be in force and
13 effect from and after its passage, approval and publication.
