HomeMy WebLinkAboutORD 11661 0 BILL NO. 19 ORDINANCE NO. 1166 I� LJ 3 11 BY COUNCILMAN DAVENPORT 4 AN ORDINANCE ADDING SECTION 11 -5 -10 TO CHAPTER 10 OF TITLE XI OF THE CODE OF THE CITY OF CALDWELL, IDAHO, AUTHORIZING THE CHIEF OF POLICE 5 TO DETERMINE AND DESIGNATE RAIIR OAD GRADE CROSSINGS WHERE HAZARDS EXIST AND TO PLACE AND MAINTAIN STOP SIGNS DIRECTING VEHICULAR TRAF- 6 FIC APPROACHING THE CROSSING TO COME TO A FULL STOP PRIOR TO THE ENTERING OF THE CROSSING WHERE ELECTRICAL AND MECHANICAL ZONING SIG - 7 NALS DO NOT EXIST AND SETTING FORTH OTHER REGULATIONS PERTAINING THERETO AND MAKING IT UNLAWFUL FOR THE DRIVER OF ANY VEHICLE TO FAIL g TO STOP AT SUCH RAILROAD GRADE CROSSING IN ACCORDANCE WITH THE PROVISIONS OF THIS ORDINANCE TO BE IN FORCE AND EFFECT AFTER ITS 9 PASSAGE, APPROVAL AND PUBLICATION. BE IT ORDAINED By the Mayor and Council of the City of 0 �1aA z <� yy d 'U �i c� it Caldwell, Idaho: 12 Section 1. That Section 11 -5 -10 be added to Title XI, Chapter 10, of the City Code of the City of Caldwell, Idaho, to read 14 15 16 as follows: "11 -5 -10: ALL VEHICLES MUST STOP AT CERTAIN RAILROAD GRADE ICROSSINGS : (A) The Chief of Police is hereby authorized to deter- 1711mine and designate railroad grade crossings where particular hazards exist and shall place and maintain a stop sign directing vehicular traffic approaching the crossing to come to a full stop prior to entering the crossing at all railroad crossings where electrical or mechanical warning signals do not exist. (B) When such stop signs are erected, it shall be unlawful for the driver of any vehicle not to stop within fifty (50) feet, but not less than fifteen (15) feet from the nearest rail of such rail- road and shall proceed only upon exercising due care. (C) Provided, however, that nothing in this section shall be construed as granting immunity to any railroad company as to liability, if any, for an accident which might occur at a crossing where stop signs are erected and in place, but such liability, if any shall be determined as by law provided. Provided, further, that no liability shall arise on the part of local authorities solely on account of the absence of any stop sign at a crossing after such stop 1 sign has been erected, but the department of highways or the city 2 shall re-erect signs under its or their respective jurisdiction 3 within a reasonable period after receiving notice of their absence." 4 Section 2.
