HomeMy WebLinkAboutORD 11633 4 5 6 1 13 c� 14 �aA z<� 15 ®a tia ':N 16 A �q p;.o U4 17 18 0 BILL NO. 14 n LJ ORDINANCE N0. 11 6 BY COUNCILMAN KEYS AN ORDINANCE AMENDING SECTION 5 -1 -3 OF CHAPTER 1 OF TITLE V OF THE CITY CODE OF THE CITY OF CALDWELL, IDAHO, PLACING DUTIES UPON OWNERS MOVING BUILDINGS WITHIN THE CITY OF CALDWELL BY REQUIRING THE OWNER TO PROVIDE THE BUILDING DEPARTMENT WITH THE PRESENT AND FUTURE LOCA- TION OF THE BUILDING AND PLACING A DUTY UPON THE BUILDING DEPARTMENT TO INSPECT AND EXAMINE ALL BUILDINGS TO BE MOVED FOR COMPLIANCE WITH ALL CODES APPLICABLE THERETO, AND TO DETERMINE WHETHER THE BUILDING WILL BE CONSISTENT WITH THE TYPE OF EXISTING BUILDINGS IN THE AREA TO WHICH IT WILL BE MOVED, WITH THE FURTHER PROVISION THAT THE OWNER SHALL FILE WITH THE BUILDING DEPARTMENT A SURETY BOND OR CASH IN AN AMOUNT TO BE SET BY THE BUILDING INSPECTOR THAT WILL GUARANTEE THAT THE BUILDING WILL BE BROUGHT INTO COMPLIANCE WITH THE BUILDING CODE AND TO COMPLY WITH THE TYPE OF BUILDINGS IN THE AREA TO WHICH IT WILL BE MOVED, AND GUARANTEE PROMPT CONSTRUCTION OF THE BUILDING IN COMPLIANCE WITH ALL APPLICABLE CODES AND ZONING REGULATIONS; AND PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT ON MAY 1, 1969. BE IT ORDAINED By the Mayor and Council of the City of Caldwell, Idaho: Section 1. That Section 5 -1 -3 of Chapter 1 of Title V of the City Code of the City of Caldwell, Idaho, be amended to read as follows: "5 -1 -3: MOVING BUILDINGS AND DUTIES OF OWNERS: It shall be unlawful for any person to move any building along, over, or through any public place within the Corporate Limits without first having applied to and obtained from the Building Inspecter a permit so to do and without thereafter complying with all of the provisions of said permit and this Chapter. And further, before any building or structure for which a moving permit is required is moved into or within the city, the owner or his agent shall: (A) Provide the Building Department with present location and future destination of the building or structure to be moved. That all ordinances or parts of ordinances in 1211 conflict herewith are hereby repealed. Z 13 Section 3. That this ordinance shall be in force and 0 0 14 effect from and after May 1, 1969.
