AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF PRO-
PERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION HAS BEEN
PRESENTED FOR THE VACATION OF POPLAR STREET BETWEEN COLLEGE AVENUE
AND COLORADO AVENUE, AS SHOWN ON THE PLAT OF MOUNTAIN VIEW ADDITION
TO CALDWELL, IDAHO, ON FILE MAY 10, 1907, IN BOOK 2 OF PLATS AT
PAGE 53, IN THE OFFICE OF THE COUNTY RECORDER OF CANYON COUNTY,
IDAHO.
8 BE IT ORDAINED AND ESTABLISHED By the Mayor and the
9 Council of the City of Caldwell, Idaho:
10 Section 1. That an application has been presented to
11 the Mayor and Council of the City of Caldwell, Idaho, for the pas -
12 sage and approval of an ordinance vacating Poplar Street between
Z 13 College Avenue and Colorado Avenue, as said street is shown on the

0 ga 14 plat of Mountain View Addition to Caldwell, Idaho, on file May 10,
z 115 1907 in Book 2 of Plats at Page 53, in the office of the County

1 6 Recorder of Canyon County, Idaho, subject to the City of Caldwell
P �1J 17 reserving unto itself and to all utility companies all existing ease -
a
18 ment rights in the area comprising said street and sewer lines,
19 power lines, gas lines and telephone lines, as presently located
20 thereon or therein. With the further reservation to the City of
21 Caldwell and all utility companies with easement rights in the
22 area comprising said street, and access to and from said area to
23 maintain, repair Or replace the present existing sewer, power, tele-
24 phone and gas lines as presently located thereon or therein.
25 Section 2. That said application will be considered under
26 a suspension of the requirements that an ordinance be read on three
27 different days at a meeting of the Council of the City of Caldwell,
28 Idaho, to be held on the 2nd day of June, 1969, at the hour of 8:00
29 o'clock p.m. at the Council Chambers in the City Hall in the City
30 of Caldwell; when and where, or prior to which date, any citizen
31 of the City of Caldwell or any owner of property in the City of
32 Caldwell may file with the Clerk of the City of Caldwell, any claim
1 for damages which any such citizen or owner of property may sustain
2 by reason of the vacation of the said property and all claims for
a damages so filed will be considered and ascertained by the Council
4 of the City of Caldwell at said meeting.
5 Section 3. Notice of the foregoing will be given to all
6 citizens of, and owners of property in the City of Caldwell, Idaho,
7 by publication of this ordinance in the News - Tribune, a newspaper
8 published in the City of Caldwell, Idaho, in one issue thereof
9 published on May 10, 1969
10 PASSED By the Council of the City of Caldwell this 5th
11 day of May, 1969.
