HomeMy WebLinkAboutORD 1153BILL NO. 7 ORDINANCE NO. 1153 BY COUNCILMAN MARTIN 8 AN ORDINANCE AMENDING CHAPTER 11 OF TITLE XI OF THE CITY CODE OF THE CITY OF CALDWELL ESTABLISHING A BASIC RULE FOR THE SPEED OF VEHICLES ON THE HIGHWAYS AND STREETS OF THE CITY OF CALDWELL, AND SETTING PRIMA FACIE SPEED LIMITS THEREFOR, AND GRANTING TO THE CITY COUNCIL OF THE CITY OF CALDWELL AUTHORITY TO ALTER BY RESOLU- TION ANY PRIMA FACIE SPEED LIMIT THEREFOR AS ESTABLISHED IN THIS ORDINANCE; REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT WITH THIS ORDINANCE, AND PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION. 10 BE IT ORDAINED By the Mayor and Council of the City of 11 Caldwell, Idaho: 12 Section 1. That Chapter 11 of Title XI of the City 13 Code of the City of Caldwell, Idaho, is hereby amended to read 0 a A 14 as follows: x < 15 "11 - 11 - 1: BASIC RULE AND PRIMA FACIE LIMITS. a. No z ®� o - 16 person shall drive a vehicle on a highway or street at a speed 17 greater than is reasonable and prudent under the conditions and 18 having regard to the actual and potential hazards then existing. 19 In every event speed shall be so controlled as may be necessary 20 to avoid colliding with any person, vehicle, or other conveyance 21 on or entering the highway or street in compliance with legal 22 requirements and the duty of all persons to use due care. 23 b. Where no special hazard exists that requires lower 24 speed for compliance with paragraph (a) of this section the speed 25 of any vehicle not in excess of the limits specified in this sec - 26 tion or established as hereinafter authorized shall be lawful, 27 but any speed in excess of the limits specified in this section 28 or established as hereinafter authorized shall be prima facie 29 evidence that the speed is not reasonable or prudent and that it 30 is unlawful: 31 (1) Upon any street or avenue designated as a highway of the State at such speed as shall 32 be established by the Highway Board of the 1 Department of Highways of the State of Idaho. (2) Thirty (30) miles per hour upon arterial or through streets not designated as high- ways of the State of Idaho. (3) Twenty (20) miles per hour when passing a school building or grounds during the hours of 8 :00 A.M. and 5 :00 P.M. school days only when so posted. (4) Twenty (20) miles per hour on all other streets or alleys whether posted or not. 21 mine that any prima facie speed hereinbefore set forth is greater 22 or less than is reasonable or safe under the conditions found to 23 exist upon any street, avenue, or alley, the Council may, by resolu- 24 tion, declare a reasonable and safe prima facie speed limit there - 25 upon, which shall be effective at all times after posting by appro- 26 priate speed limit signs." 27 Section 2. All ordinances, resolutions, orders or parts 28 therewith, in conflict herewith are hereby repealed, rescinded and 29 annulled. 30 Section 3. This ordinance shall be in full force and 311 effectfrom and after its approval, passage and publication, as 32 required by law. The driver of every vehicle shall, consistent with Q X141 15 the requirements of paragraph (a), drive at an appropriate reduced 0 15 16 speed when approaching a hill crest, when traveling upon any narrow) 9Z 17 or winding roadway, and when special hazards exist with respect to 0 18 pedestrians or other traffic or by reason of weather, street or 19 highway conditions. 20 11 -11 -2: EXCEPTION: Whenever the Council shall deter- 21 mine that any prima facie speed hereinbefore set forth is greater 22 or less than is reasonable or safe under the conditions found to 23 exist upon any street, avenue, or alley, the Council may, by resolu- 24 tion, declare a reasonable and safe prima facie speed limit there - 25 upon, which shall be effective at all times after posting by appro- 26 priate speed limit signs." 27 Section 2.
