HomeMy WebLinkAboutORD 1145i t 11 2 3 1 4 5' 6i 7 8 9 1 10 ill z 131 Aar 14j le a 15' a 1 6 171 0 BILL NO. 26 • ORDINANCE NO. 1145 BY COUNCILMAN MARTIN AN ORDINANCE AMENDING SECTION 11 -13 -4 OF CHAPTER 13 OF TITLE XI OF THE CITY CODE OF THE CITY OF CALDWELL, IDAHO, CHANGING PERIODS OF PARKING OF MOTOR VEHICLES WHEREBY ONE NICKEL SHALL BE DEPOSITED FOR EACH THIRTY MINUTES OF PARKING AND ONE DIME FOR FOUR HOURS OF PARKING ON DESIGNATED LOTS, WITH OTHER PERIODS OF TIME OF PARKING FOR EITHER ONE NICKEL OR MORE, OR ONE DIME OR MORE IN PARKING METER ZONES; AMENDING SECTION 11 -13 -7 OF CHAPTER 13, TITLE XI OF THE CITY CODE OF THE CITY OF CALDWELL, IDAHO, MAKING IT UNLAWFUL FOR ANY PERSON TO DEPOSIT OR INSERT, OR CAUSE TO BE DEPOSITED OR INSERTED IN ANY PARKING METER, ANY COIN EXCEPTING A NICKEL OR A DIME; AMEND- ING SECTION 11 -13 -9 OF CHAPTER 13, TITLE XI OF THE CITY CODE OF THE CITY OF CALDWELL, IDAHO, PROVIDING IN THE EVENT OF PARKING OF A VEHICLE IN VIOLATION OF SECTION 11- 13--4, THE OWNER OR OPERATOR, WITHIN FORTY -EIGHT HOURS OF THE TIME NOTICE IS PLACED UPON HIS VEHICLE OF SUCH VIOLATION, MAY PAY TO THE POLICE DEPARTMENT IN SATISFACTION OF SUCH VIOLATION TWENTY -FIVE CENTS FOR EACH HOUR OR FRACTION THEREOF THAT SUCH VEHICLE WAS PARKED IN VIOLATION OF THE PROVISIONS OF SECTION 11 -13 -4; THAT SHOULD AN OWNER OR OPERATOR FAIL TO REPORT TO THE POLICE DEPARTMENT AND MAKE PAYMENT AS PRO- VIDED IN SECTION 11 -13 -9 OF THE CITY CODE THAT SUCH PERSON SHALL THEREAFTER BE SUBJECT TO FINE AS PROVIDED IN SECTION 11 -13 -10 OF THE CITY CODE; MAKING IT THE DUTY OF THE CHIEF OF POLICE TO FILE A COMPLAINT BEFORE THE POLICE JUDGE AGAINST ALL PERSONS WHO DO NOT REPORT AND MAKE PAYMENT WITHIN FORTY -EIGHT HOURS FOR VIOLATING THE PROVISIONS OF SECTION 11 -13 -4 OF THE CITY CODE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND RESOLUTIONS, OR PARTS THEREOF, IN CON- FLICT WITH THIS ORDINANCE, AND PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT ON DECEMBER 15, 1968. BE IT ORDAINED By the Mayor and Council of the City of Caldwell, Idaho: Section 1. That Section 11 -13 -4 of Chapter 13 of Title XI of the City Code of the City of Caldwell, Idaho, be amended to read as follows: "11 -13 -4: PARKING METERS: Each parking meter shall be so equipped, designed and constructed that upon deposit herein of 2 611 United States coins in the following denominations, said meter shall visibly indicate that a vehicle may occupy a space adjacent to said parking meter for the following periods of time after the deposit of any suchcoin: DENOMINATION OF COIN: PARKING PERIOD: One nickel For each 30 minutes One dime 4 hours on designated lots :i Following resolution of the Council of the City, the Chief of Police may designate a parking meter zone in which shall be in- stalled parking meters so equipped that in addition to the fore- going, upon deposit therein of two nickels, it shall indicate that a vehicle may occupy the space thereto for a period of one (1) hour or upon the deposit of twenty (20) cents either four (4) nickels or two (2) dimes for a period of two (2) hours, and on designated lots one (1) dime for a period of four (4) hours after deposit of said dime." o s° c� 16 Section 2. That Section 11 -13 -7 of Chapter 13, Title 11' XI of the City Code of the City of Caldwell, Idaho, be amended 12 to read as follows: 13!' "11 -13 -7: DENOMINATION OF COIN: It shall be unlawful 14 and a violation of the provisions of this Chapter for any person 15;, to deposit or insert, or cause to be deposited or inserted, in 16 any parking meter, anything whatsoever except a nickel or a dime 17 coin." 18 Section 3. That Section 11 -13 -9 of Chapter 13, Title 19 XI of the City Code of the City of Caldwell, Idaho, be amended 20 to read as follows: 21 "11 -13 -9: POLICE TO ENFORCE: It shall be the duty of 22 each police officer designated as Meter Officer or Meter Maid 23 observing a violation of the provisions of Section 11 -13 -4 or 24 Section 11 -13 -6 of this Chapter, to leave at or upoh such vehicle 25 a notice that the vehicle has been parked in violation of the pro- 26 visions of this Chapter; the said notice shall bear the date and hour of leaving the same at or upon such vehicle, and the notice shall instruct the owner or operator of such vehicle to deposit said notice in any of the red courtesy collection boxes attached to the meter posts or bring said notice to the Police Department. It shall be the duty of such police officer to leave at or upon such vehicle a separate notice for each hour, or fraction thereof, I 3 7 8 9 10 121,1 13',I o LI 14',' 15 0 16 17 0 1s 19 20 21 22 23 0 • that such vehicle remains parked in violation of the provisions of Section 11 -13 -4. Each such owner or operator may, within forty -eight (48) hours of the time of such notice, pay to the Police Department as a penalty for, and in full satisfaction of such violation, the amount of twenty -five cents (25¢) for each hour or fraction thereof, that such vehicle was parked in viola- tion of the provisions of Section 11 -13 -4. The failure of such owner or operator to report and to make such payment to the Police Department within said forty -eight (48) hours shall render such owner or operator subject to the fine provided for by Section 11 -13 -10 of this Chapter. The notice above mentioned shall be made and numbered in duplicate and it shall be the duty of each police officer as men- tioned above to file one (1) copy of such notice with the Police Department. It shall be the duty of the Chief of Police to file a complaint before the Police Judge against all persons who do not report and make payment to the Police Department within the above mentioned forty -eight (48) hours." Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. That this ordinance shall be in force and effect from and after December 15, 1968.
