ORDINANCE NO. 1139 DETERIE'IINING THAT NO OBJECTIONS TO THE VACATION
5!OF THE EAST 10 FEET OF BROCK AVENUE BETWEEN WEST ASH STREET AND WEST
6I HAZEL STREET, AS SHOWN ON THE PLAT OF WEST ASH ADDITION ON FILE IN
BOOK 8 OF PLATS AT PAGE 7, IN THE OFFICE OF THE COUNTY RECORDER,
CANYON COUNTY, IDAHO, HAS BEEN MADE OR FILED AND THAT NO CLAIM OR
7 CLAIMS FOR DAMAGES WHICH WOULD BE SUSTAINED BY REASON THEREOF HAVE
BEEN FILED; DETERMINING THAT THE VACATION OF SAID BROCK AVENUE HERE -
8 INBEFORE DESCRIBED IN THIS CAPTION IS TO THE BEST INTEREST AND AD-
iVANTAGE OF THE CITY OF CALDWELL, ITS CITIZENS AND PROPERTY OWNERS;
91DETERMINT-NG BY REASON OF THE VACATION OF BROCK AVENUE HEREINBEFORE
DESCRIBED IN THIS CAPTION; PROVIDING THAT THE TITLE TO SAID BROCK
10 AVENUE, HEREINBEFORE DESCRIBED IN THIS CAPTION, AS VACATED, SHALL
REVERT TO THE PERSONS DEDICATING THE SAME, THEIR SUCCESSORS, HEIRS
11 AND ASSIGNS. REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE
12 AND ITS EFFECT.

1911 thereof on the 10th day of August, 1968, notice was given to all citi�
zens and owners of property in the City of Caldwell, Idaho, that an
2 11 ! !application has been presented to the Mayor and Council of the City
of Caldwell, Idaho, requesting the passage and approval of an
ordinance vacating the East 10 feet of Brock Avenue between West Ash
24 Street and West Hazel Street, as shown on the Plat of West Ash Addi-
25 tion on file in Book 8 of Plats at Page 7, in the office of the Count
26 ] Recorder, Canyon County, Idaho.
Section 2. That no objections to the granting of said ap-
plication have been made or filed and no claim or claims for damages
which would result therefrom; and it is hereby determined that no
citizen of or owner of property of the City of Caldwell, Idaho, will
be damaged or injured by the vacation of said Brock Avenue herein -
before described in Section 1 of this ordinance, and that it is

the News - Tribune,

Avenue as described in Section 1 be vacated.
Section 3. Be it ordained and established that Brock
Avenue as hereinbefore described in Section 1 of this ordinance,
from and after its passage, approval and publication of this ordin-
ance, shall be vacated, and shall no longer be open or subject to the
use of the public; and thereupon the title to said Brock Avenue as
hereinbefore described in Section 1 of this ordinance, shall pass and

revert to the persons dedicating the same or their successors, heirs
and assigns, free of all easement and dedication heretofore existing
for a public street therein.
Section 4. It appearing that no claim or claims for
damages sustained by any citizen or citizens of the City of Caldwell,
Idaho, or by any owner or owners of property therein, by reason of
16jithe vacation of said Brock Avenue as hereinbefore described in
171j Section 1 of this ordinance, has been filed or made, it is hereby
18 determined that no damages will be sustained by the citizens of or
19 owners of property in the City of Caldwell, Idaho, by reason of the
20 vacation of said Brock Avenue above described.
21 Section 5. That all ordinances or parts of ordinances in
22!11 conflict herewith are hereby repealed.
23 PASSED By the Council of the City of Caldwell this 3rd day
24! of September, 1968.
