HomeMy WebLinkAboutORD 11261 BILL NO. 2 ORDINANCE NO. 1126 BY COUNCILMAN HARRISON AN ORDINANCE GRANTING TO THE OREGON SHORT LINE RAILROAD COMPANY, (UNION PACIFIC RAILROAD COMPANY, LESSEE), ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO CONSTRUCT, OPERATE AND MAINTAIN A STANDARD GAUGE RAIL- ROAD SPUR TRACK OVER AND ACROSS ROEDEL AVENUE IN THE NORTHWEST QUARTE OF SECTION 21, TOWNSHIP 4 NORTH, RANGE 3 WEST OF THE BOISE MERIDIAN, IN CANYON COUNTY, IDAHO. 8 Be it ordained by the Mayor and City Council of the City 9 of Caldwell, Idaho. 10 SECTION 1. That the Oregon Short Line Railroad Company 11' I (Union Pacific Railroad Company, Lessee), its successors and assigns, 121 be, and the same is hereby, granted the franchise and right to con - 13'i stuct, operate and maintain a standard gauge railroad spur tract over a a� and across Roedel Avenue in the Southeast Quarter Northwest Quarter a 14 1 of Section 21, Township 4 North, Range 3 West of the Boise Meridian, ow 0 ' 16 in Canyon County, Idaho, the center line of said spur to be on a line � � U 17 described as folowsa 18 Beginning at the SW corner of the SEINW of said Section 21; 19 Thence Southerly 63.0 feet along the North and South 20 center line of the West 2 of said Section 21 to the intersection of said North and South center line and 21 the center line of the Oregon Short Line Railroad Company's Wilder Branch main track as now constructed 22 and operated; 23 Thence Westerly 380.23 feet along said main track center line; 24 Thence Northeasterly 93.99 feet along a curve to the 25 left having a radius of 939.719 feet through a central angle of 5 to a point of tengency; 26 Thence Northeasterly 10.0 feet along a line tangent to 27 the last described curve at its point of beginning, to a point of curve; 28 Thence Northeasterly 136.8 feet along a curve to the 29 left, tangent at its point of beginning to the last described line, having a radius of 459.276 feet through 30 a central angle of 17 06' to a point in said railroad company's Northerly right of way boundary; 31 Thence continuing Northeasterly 135 .07 feet along the 32 last described curve and through a central angle or 16 0 531 to the true point of beginning of track crossing Roedel Avenue; Og 0 w 0 r M y V passage, approval and publication.
