That there is hereby added Chapter 9 to Title 10 V of the City Code of the City of Caldwell, to read as follows: 11 "CHAPTER 9 121 REQUIREMENT OF FALLOUT PROTECTION z I 13 SECTION: ° 90 1 14 5 -9 -1: Requirement of Fallout Protection 4d;5 5 -9 -2: Exemption from Requirement of Fallout Protection p -j 15 5 -9 -3: Policy � � 16 5 -9 -1: REQUIREMENT: That every officer, board, department, com- � U 17 mission, or commissions of the City of Caldwell, charged with the P H V 18 duty of preparing specifications, or awarding or entering into con - 19 tracts for the design, erection, or construction of buildings, or 2 other structures, including additions to existing structures, for 21 the City of Caldwell, shall incorporate or cause to be incorporated 22 in such buildings, or other structures, fallout protection for at 23 least its normal anticipated population which shall meet or exceed 24 the minimum space and fallout protection criteria recommended by 25 the Office of Civil Defense, United States Department of Defense, 26 unless exempted from such shelter requirement in accordance with 4-1 Section 5 -9 -2 of this Chapter. 28 5 -9-2: EXEMPTION: That the City Council may exempt buildings or 29 structures from this requirement where they find such incorporation 30 of a fallout shelter will create an additional net cost in the con - 31 struction of such building or structure in excess of one -half of one 32 per cent (.005) of the estimated cost thereof without a fallout 11 12 13 14 lb 16 � � U 17 0 18 19 20 21 shelter being so incorporated, or that other factors as they may determine make it unnecessary or impractical for the incorporation of a fallout shelter in such buildings or structures. 5 - - POLICY: That it shall be the policy of the City of Cald- well that fallout shelters be incorporated in all public buildings of the City of Caldwell to the fullest extent practicable, in order to provide protection against radiation for the greatest number of people in the event of nuclear attack, provided that the minimum requirements of all rules, regulations, and ordinances for the construction, erection and maintenance of buildings or structures shall not be waived to an extent that endangers the life, limb, health, property, safety or welfare of the public." Section 2. This ordinance shall be in full force and effect from and after its passage, approval and publication. PASSED By the Council of the City of Caldwell, this 19th day of February, 1968.
