AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF PRO-
PERTY IN THE CITY OF CALDWELL, IDAHO, THAT AN APPLICATION HAS BEEN
PRESENTED FOR THE VACATION OF THIRD AVENUE BETWEEN BLOCK 94 AND
BLOCK 95 ACCORDING TO THE REVISED MAP OF CAIDWELL, IDAHO, FILED AT
3:00 P.M., JULY 29, 1891 AND NOW ON FILE AND OF RECORD IN BOOK 1
OF PLATS, PAGE 20, RECORDS OF CANYON COUNTY, IDAHO, AND BETWEEN THE
SOUTHWESTERLY BOUNDARY LINE OF ALBANY STREET AND THE NORTHEASTERLY
RIGHT -OF -WAY LINE OF THE UNION PACIFIC RAILROAD COMPANY.
BE IT ORDAINED AND ESTABLISHED By the Mayor and the Council
of the City of Caldwell, Idaho:

11 Section 1. That an application has been presented to the
12 Mayor and Council of the City of Caldwell, Idaho, for the passage
13' and approval of an ordinance vacating all of Third Avenue between
14 Block 94 and Block 95 according to the revised map of Caldwell, Id
15 filed at 3:00 P.M., July 29, 1891, and now on file and of record in
161 Book 1 of Plats, page 20, Records of Canyon County, Idaho, and be-
17 tween the Southwesterly boundary line of Albany Street and the North -

easterly right -of -way line of the Union Pacific Railroad Company.
19',1 Section 2. That said application will be considered under

20� a suspension of the requirements that an ordinance be read on three
21 different days at a meeting of the Council of the City of Caldwell,

22� Idaho, to be held on the 8th day of January, 1968, at the hour of
231,1 8 :00 o'clock P.M. at the Council Chambersin the City Hall in the City
24 of Caldwell; when and where, or prior to which date, any citizen of
251 the City of Caldwell or any owner of property in the City of Caldwell
26 may file with the Clerk of the City of Caldwell, any claim for damages
2 which any such citizen or owner of property may sustain by reason of
28 the vacation of the said property and all claims for damages so filed
29 will be considered and ascertained by the Council of the City of
30 Caldwell at said meeting.
31 Section 3. Notice of the foregoing will be
given to all
32 citizens of, and owM= of property in the City of Caldwell, Idaho, by

1 publication of this ordinance in the News - Tribune, a newspaper
2 published in the City of Caldwell, Idaho, in one issue thereof
3 published on December 9, 1967.
