4 AN ORDINANCE GIVING NOTICE TO ALL QUALIFIED ELECTORS OF THE CITY OF
CALDWELL, IDAHO, THAT IT IS THE INTENTION OF THE CITY OF CALDWELL
5 TO SELL A PARCEL OF REAL PROPERTY OWNED BY THE CITY OF CALDWELL
CONTAINING 2.5 ACRES OF LAND LOCATED IN THE SOUTHWEST QUARTER OF
6 SECTION 21, TOWNSHIP 4 NORTH, RANGE 3 WEST OF THE BOISE MERIDIAN,
AS MORE PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE,
7, WHICH SALE WILL BE CONDUCTED IN ACCORDANCE WITH THE PROVISIONS OF
SECTIONS 245, 247 AND 249 OF CHAPTER 429 OF THE 1967 IDAHO SESSION
81 LAWS, AND SECTION 246 OF CHAPTER 10 OF THE FIRST EXTRAORDINARY
SESSION OF THE 1967 IDAHO SESSION LAWS.

101 BE IT ORDAINED AND ESTABLISHED By the Mayor and the
1111 Council of the City of Caldwell, Idaho:
12 Section 1. That it is the intention of the City of
z 13 Caldwell to sell the following described real property at a time
a �: 14 subsequent to the date of the public hearing hereinafter set forth
15 in accordance with the provisions of Sections 245, 247 and 249 of
0 16 Chapter 429 of the 1967 Idaho Session Laws, and Section 246 of

9z 17 Chapter 10 of the First Extraordinary Session of the 1967 Idaho
5 18I Session Laws, said real property being described as follows, to -wit:
19 COMMENCING at the Northeast corner of the South-
west Quarter of Section 21, Township 4 North, Range
20 3 West of the Boise Meridian; thence South 472.3
1 feet along the East line of aforesaid Southwest
211 Quarter; thence West and parallel with the South
boundary line of the right -of -way of the Wilder
22 Branch of the Oregon Shortline Railroad, a distance
of 970 feet to the TRUE POINT OF BEGINNING: THENCE
231, continuing West and parallel with the South boundary
i' line of the aforesaid railroad right -of -way, a dis-
24I tance of 265 feet; thence South and parallel with
the East line of aforesaid Southwest Quarter, a
25 distance of 410 feet; thence East and parallel with
the South boundary line of the aforesaid railroad
26 right -of -way, a distancecf 265 feet; thence North
il and parallel with the East line of aforesaid South -
27I west Quarter, a distance of 410 feet to the TRUE
II POINT OF BEGINNING, and containing 2.5 acres.

291 Section 2. That the public hearing of said intention to

30 sell by the City Council of said real property will be considered
31' at a meeting of the Council of the City of Caldwell, Idaho, to be
32 j held on the 20th day of November, 1967 at the hour of 8:00 o'clock
1 P. M. at the Council Chambers in the City Hall in the City of Cald-
2 I 1 1 well; when and where any qualified electors of the City of Caldwell
3 may file their petitions with the Clerk of the City of Caldwell
4, expressing dissatisfaction with said intended sale of said real
5 property, and at which time if any petition be filed containing the

611 names of qualified electors of the City of Caldwell in a number
7, equal to ten percent of the total votes cast for Mayor in the pre-
8 ceding City election, said intended sale will not be made until
9 the City Council shall cause a special election to be held on the
10 question of whether or not the real property described in Section
11 1 of this ordinance shall be sold.
