AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF PRO -
5 PERTY IN THE CITY OF CALDWELL, THAT AN APPLICATION HAS BEEN PRESENTE
FOR THE VACATION OF THE ALLEY IN BLOCK 36 MOUNTAIN VIEW ADDITION TO
6 CALDWELL, IDAHO, ACCORDING TO THE PLAT OF SAID ADDITION, FILED MAY
10, 1907 IN BOOK 2 OF PLATS AT PAGE 53, IN THE OFFICE OF THE COUNTY
7 RECORDER, CANYON COUNTY, IDAHO
8 Be it ordained and established by the Mayor and Council
9 of the City of Caldwell, Idaho:
10 Section 1. That an application has been presented to the
11 Mayor and Council of the City of Caldwell, Idaho, for the passage
1 2 and approval of an ordinance vacating the alley in Block 36 Mountain
13 View Addition to Caldwell, Idaho, according to the Plat of said Addi.
14 tion, filed May 10, 1907 in Book 2 of Plats at page 53, in the office
15 of the County Recorder, Canyon County, Idaho.
16 Section 2. Subject to the City of Caldwell reserving unto
17 itself and to all utility companies all existing easement rights in
18 the area comprising said alley for sewer lines, power lines, tele-
19 phone lines and gas lines as presently located thereon or therein,
2 with the further reservation to the City of Caldwell and all utility
21 companies with easement rights in the area comprising said alley
22j for access to and from said area to maintain, repair or replace the
23', present existing sewer, power, telephone and gas lines as presently

2 located thereon or therein, that said application will be considered
25 under a suspension of the requirement that an ordinance be read on
26 three different days at a meeting of the Council of the City of
27 Caldwell to be held on the 21st day of August, 1967, at the hour of
28 8:00 o'clock P.M., at the Council Chambers in the City Hall in the
29I City of Caldwell; when and where, or prior to which date, any
citizen of the City of Caldwell or any owner of property in the
City of Caldwell may file with the Clerk of the City of Caldwell
any claim for damages which any such citizen or owner of property

1 may sustain by reason of the vacation of said property and all claims
2 for damages so filed will be considered and ascertained by the Coun-
3 cil of the City of Caldwell at said meeting.
4 Section 3. Notice of the foregoing will be given to all
5 citizens of, and owners of property in the City of Caldwell, Idaho,
6 by publication of this ordinance in the News - Tribune, a newspaper
7 published in the City of Caldwell, Idaho, in one issue thereof pub-
8 lished on the 12th day of August, 1967.
9 PASSED By the Council of the City of Caldwell this 7th day
10 of August, 1967.
11 APPROVED By the Mayor of the City of Caldwell this 7th day
12 of August, 1967.
