4 AN ORDINANCE REPEALING CHAPTER 2 OF TITLE XII OF THE CITY CODE OF
THE CITY OF CALDWELL AS IT PERTAINS TO THE DIVISION OF THE CITY
5 INTO WARDS, AND ENACTING A NEW CHAPTER 2 OF TITLE XII OF THE CITY
CODE ESTABLISHING PRECINCTS FOR VOTING; ALSO AMENDING SECTION
6 12 -3 -1 OF CHAPTER 3 OF TITLE XII OF THE CITY CODE OF THE CITY OF
CALDWELL PROVIDING FOR ELECTION JUDGES AND DISTRIBUTING CLERKS TO
7 SERVE IN PRECINCTS RATHER THAN WARDS, AND PROVIDING FOR THEIR
APPOINTMENT AT THE REGULAR MEETING THE MONTH PRECEDING AN ELECTION;
8 AND AMENDING SECTION 1 -5 -2 OF CHAPTER 5 OF TITLE I OF THE CITY CODE
OF THE CITY OF CALDWELL ELIMINATING THE REPRESENTATION OF COUNCIL-
S MEN BY WARDS AND PROVIDING FOR THEIR ELECTION AT LARGE; ALL OF
WHICH IS REQUIRED AND IN ACCORDANCE WITH HOUSE BILL NO. 3 AS
10 AMENDED AND PASSED BY THE 1967 LEGISLATURE OF THE STATE OF IDAHO.

12 BE IT ORDAINED By the Mayor and Council of the City of
13 Caldwell, Idaho:
° 14 Section 1. That Chapter 2 of Title XII of the City Code

15 of Caldwell, Idaho, in compliance with the provisions of House Bill

16 No. 3 as amended and passed by the 1967 Legislature of the State of
17 Idaho eliminating the division of cities into wards and establishin
a

18 voting precincts in lieu thereof, there is hereby substituted a new
19 Chapter 2 to read as follows:
20 "CHAPTER 2
21 PRECINCTS
SECTION:
12 -2 -1: Precincts
12 -2 -1: PRECINCTS: The City is hereby divided into four
(4) Precincts as follows:

First Precinct: All that part of Caldwell lying

east and north of the main track
of the Oregon Short Line Railroad.

Second Precinct: All that part of Caldwell lying

south and west of the main track
of the Oregon Short Line Railroad

and east and south of South
Eighteenth Avenue and east of

South Montana Avenue.

Third Precinct: All that part of Caldwell lying

26 Section 3• That Chapter 5 of Title I, Section 1 -5 - of
27 the City Code of Caldwell, Idaho, in compliance with the provisions
28 of House Bill No. 3 as amended and passed by the 1967 Legislature
29 of the State of Idaho is hereby amended to read as follows:
30 "l -5 -2: REPRESENTATION: There shall be six (6) Council -
31 men elected at large to represent the municipality at each municipal
32 , election hereafter three (3) Councilmen shall be elected from the

ments and provisions of House Bill No. 3 as amended and passed by

the 1967 Legislature of the State of Idaho is hereby amended to

"12 -3 -1: OFFICERS OF ELECTIONS: The Council shall in

the month prior to an election, whether general or special, appoint

an election judge and such clerks as may be necessary for each

voting precinct within the City. The said election judge and

clerks shall be qualified City electors and it shall be the duty
19
of the election judge to supervise the election in his polling
20
place and designate the duties of the clerks. Within five (5)
21
days following appointment the City Clerk shall so notify the

election officers, and the Clerk shall request each appointee to

give notice of his acceptance or declination within ten (10) days

thereafter; and the Council shall at its next meeting thereafter
25 fill such vacancies as shall appear."
26 Section 3• That Chapter 5 of Title I, Section 1 -5 - of
27 the City Code of Caldwell, Idaho, in compliance with the provisions
28 of House Bill No. 3 as amended and passed by the 1967 Legislature
29 of the State of Idaho is hereby amended to read as follows:

City at large to serve for a term of four (4) years or until their
successors are elected and qualified."
Section 4. All ordinances, resolutions, orders or parts
therewith, in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This ordinance shall be in force and effect
at the next ensuing general election after its approval, passage
and publication as required by law.
