4 AN ORDINANCE CHANGING FROM THE "AB" RESIDENCE ZONE TO THE "CD"
COMMERCIAL ZONE THE REAL PROPERTY HEREINAFTER DESCRIBED IN THIS
5 ORDINANCE, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH.

7 BE IT ORDAINED AND ESTABLISHED By the Mayor and Council of
8 the City of Caldwell, Idaho:
9 Section 1. That by a resolution passed by the Council and
10 approved by the Mayor on the 19th day of June, 1967 the City Council
11 of the City of Caldwell signified its intention to change from the
12 "AB" residence zone to the "CD" commercial zone of the City of Cald-
4 13 well, Idaho, the following described real property:
o� 14 Block 43 of GOLDEN GATE ADDITION to CALDWELL, IDAHO,
according to the PLAT of said ADDITION filed December
15 21, 1907 in Book 2 of Plats at page 78, in the office
® of the County Recorder, Canyon County, Idaho, and
16 BEGINNING at the Southwest corner of Section 23, Town-
17 ship 4 North, Range 3 West of the Boise Meridian; thence
North along the West line of said Section 23 to its inter -
16 section with the centerline of Denver Street Extended;
thence Northwesterly along the centerline of Denver
19 Street Extended and Denver Street to its intersection
with the centerline of Juniper Street; thence East along
20 the centerline of Juniper Street to its intersection with
the West line of said Section 23, which point is 331.12
21 feet North of the Southwest corner of said Section 23;
thence East to a point which is North 0 38' West, 331.12
22 feet from the Southeast corner of the Southwest Quarter
of said Section 2hence North 89 22' East, 51.83 feet;
$3 thence North 11 A 28 East, 62.00 feet to a point in the
Southerly right -of -way of Interstate Highway 80; thence
24 South 61 36' East, 502.90 feet; thence 0 38' East,
147.70 feet, to the South line of said Section 23; thence
25 South 89 22' West, 504.50 feet to the Southeast corner
of the Southwest Quarter of said Section 23; thence West
26 along the South line of the Southwest Quarter of said Sec-
tion 23 to the POINT OF BEGINNING.
and ordered and directed the City Clerk to give notice of the fact
that said Council would hold a public hearing at 8:00 o'clock P. M.
on July 10, 1967 at which time parties in interest and citizens
would have an opportunity to be heard as to their being in favor or
against said change in zoning.

Section 2. That the City Clerk pursuant to the order and
direction of the City Council has given notice of said public hear-
ing by a publication of notice thereof in the News Tribune, the
official newspaper of the City of Caldwell, in its issues of June
24 and July 1, 1967 and July 8, 1967.
Section 3. That no objection to the change from the "AB"
residence zone to the "CD" commercial zone of the real property
described in Section 1 of this ordinance have been made or filed by
any party in interest or citizen of Caldwell.
Section 4. That the real property hereinbefore described
in Section 1 of this ordinance is hereby changed from the "AB" resi-
dence zone to the "CD" commercial zone of the City of Caldwell,
Idaho, and the Clerk is instructed to change the official zoning
map of the City, a copy of which is on file in his office showing
the boundaries of the "CD" commercial zone to include the real
property described in Section 1 of this ordinance and to delete the
same from the boundaries of the "AB" residence zone, whereby said
map will reflect accordingly the change of the zoning of the real
property hereinbefore described in this ordinance.
Section 5. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
PASSED By the Council of the City of Caldwell this 10th
day of July, 1967.
