ORDINANCE NUMBER 1086
AN ORDINANCE CALLING AN ELECTION FOR THE PURPOSE OF SUBMITTING TO
THE QUALIFIED ELECTORS OF THE CITY OF CALDWELL, IDAHO, WHO ARE TAX-
PAYERS THE PROPOSITION OF THE ISSUANCE OF $298,250.00 GENERAL OBLI-
GATION LIBRARY BONDS OF SAID CITY, AND PROVIDING FOR THE ISSUANCE
OF SUCH BONDS IN THE EVENT THEY ARE VOTED AT SUCH ELECTION.
WHEREAS the construction and furnishing of a public build-
ing for use as a municipal public library, and the acquisition of a
building site therefor, is considered by the City Council of the
City of Caldwell to be necessary and essential to the health and
well -being of the inhabitants of said city; and
WHEREAS said city does not have funds available to pay the
cost of the foregoing and has determined it advisable to finance su(
cost through the issuance of the bonds of the city pursuant to the
provisions of Chapter 28 of Title 50 of the Idaho Code, and in order
to do so desires to provide for the holding of the election require(
by said chapter;
NOW, THEREFORE, Be It Ordained by the Mayor and Council
of the City of Caldwell, Canyon County, Idaho, as follows:
Section 1. That a special election is hereby called to
be held in the City of Caldwell on December 13, 1966, for the pur-
pose of submitting to the qualified electors of said city who are
taxpayers of the city the proposition set forth in the form of
ballot appearing in Section 3 hereof.
Section 2. That the polls at said election shall open at
the hour of 12:00 o'clock Noon and remain open continuously until
the hour of 8:00 o'clock P.M. and then close. Said election shall
be held at the voting places specified in the form of notice of
election set out in Section 4 hereof.
Section 3. That all persons who at the time of the
election are qualified electors of the city and who are taxpayers
thereof, properly registered and possessing the qualifications of
residents, shall be qualified to vote at said election, and that the
ballots to be used at said election shall be in substantially the
following form:

INSTRUCTIONS TO VOTERS:
To vote on the following question place a cross (X) in the square
to the right of "In favor of issuing bonds to the amount of $298,250
for the purpose provided by Ordinance Number 1086 ", or
"Against issuing bonds to the amount of $298, 5-0 for the purpose
provided by Ordinance Number 1086 ", according to the way you
desire to vote on the question. All distinguishing marks are for-
bidden and make the ballot void. If you, by mistake or accident,
mark, tear, deface or otherwise mutilate this ballot, return it to
the election judges and obtain another ballot.

Section 4. That notice of said election shall be given
by the City Clerk by publication of the following notice in The
News - Tribune, a newspaper published and having general circulation
in the City of Caldwell, once a week on the same day of five
successive weeks, the first of which publications shall be not less
than thirty (30) days prior to the date fixed for the holding of
said election, and by posting said notice in three (3) public places
in each ward in said city, one of which in each ward shall be the
voting place to be used at said election, for not less than thirty
(30) days prior to said election:
NOTICE OF SPECIAL BOND ELECTION
Pursuant to the laws of the State of Idaho and
Ordinance Number 1086 of the City of Caldwell,
County of Canyon, State of Idaho, notice is hereby
given that a special election will be held in said City
on December 13, 1966, beginning at the hour of 12:00
o'clock Noon and closing at the hour of 8:00 o'clock
P.M. of said day, for the purpose of taking a vote
upon the following question, to wit:
QUESTION: Shall the City of Caldwell, Idaho
issue and sell its negotiable coupon general
obligation bonds to the amount of $298,250,
for the purpose of providing funds with which
to construct and furnish a public building for
use as a municipal public library, and to
acquire a building site therefor, in and for
said city, as more fully provided in Ordinance
Number 1086 adopted on November 7, 1966?
Said election will be held at the following voting
places:

Notice is further given that only qualified electors of
said city who are taxpayers and who are registered as provided by
law are entitled to vote at said election. No qualified elector who
is duly registered as a voter at the last preceding general munici-
5' pal election shall be required to reregister so long as he remains,
s l or has remained, continuously after such registration, a duly quali-
7I fied elector of the City of Caldwell, but those electors who have
8j failed or neglected heretofore to vote for two successive biennial

91_ general elections in said city or who removed from the city and re-
lo,l mained away for a period of one year (provided they shall again have
11 resided in the city for at least thirty (30) days must reregister.
12 John L. Englehart, City Clerk, is ex officio registrar of
13 said city. The place of registration is the office of said City
14 Clerk on the City Hall.

Persons may register on each day at any time during the
office hours of said Clerk, beginning with the day that the notice
of election is given and continuing until and including the Saturday
next preceding the election and on Thursday, Friday and Saturday
next preceding the election, persons may register between the hours
of 9:00 o'clock A.M. and 5:00 o'clock P.M. and between the hours of
7:00 o'clock P.M. and 9:00 o'clock P.M.
The voting at said election shall be by ballot. The
ballots to be supplied the voters for their use at said election
shall be in the form set forth in Ordinance Number 1086
If at said bond election two - thirds of the qualified
electors who are taxpayers of the city voting at such election assen
to the issuing of such bonds and the incurring of the indebtedness
thereby created for the purpose of providing funds with which to
construct and furnish a public building for use as a municipal
public library, and to acquire a building site therefor, in and for
said city, such bonds shall be issued for such voted purpose in the
manner provided by the Municipal Bond Law of Idaho. Said General
the expiration of one year and ending twenty years from their date
and shall bear interest at a rate or rates not in excess of 6% per
annum and shall be payable in accordance with the provisions of
Section 50 -2811, Idaho Code, and the Municipal Bond Law of Idaho.

10 Section 5. That if at said election two - thirds of the
11 qualified electors of the city who are taxpayers of the city voting
12 thereat assent to the issuance of said General Obligation Library
13 Bonds, the bonds of the city shall be issued as hereinabove provided
141 and shall mature over a period commencing at the expiration of one
15 year from their date and ending twenty years from their date and
16 bear interest at a rate or rates not in excess of six per cent (6 %)
17 per annum, and shall be payable in accordance with the provisions
18 of Section 50 -2811, Idaho Code, and the Municipal Bond Law of Idaho.

Section 7. That said bonds shall be issued if carried

as aforesaid, and payment shall be made through the levy of taxes on

all taxable property in the City of Caldwell, beginning with the

year 1967 and continuing until principal and interest shall have

been fully paid, in such amounts and at such rates as are necessary

to assure the prompt payment of such principal and interest, and it

is hereby ordered that such taxes shall be levied annually at the
8
time and in the manner the general taxes for said city are levied
9

in each such year, in addition to all other authorized taxes and
to
assessments. The proper officer or officers of said city are hereby
ill
authorized and directed to do all things requisite and necessary to

carry out the provisions of this section and to apply the proceeds
13
of the taxes so collected to the payment of such principal and

Section 8. That all ordinances or parts thereof in con -

flict herewith are, to the extent of such conflict, hereby repealed,

and that this ordinance shall be published in one issue of the News-

and be in full force immediately upon its passage, approval and

publication.
