HomeMy WebLinkAboutORD 10701 BILL NO. 14 2 ORDINANCE NO. 1070 3 BY COUNCILMAN URRISON 4 AN ORDINANCE CALLING AN ELECTION FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF CALDWELL, IDAHO, WHO ARE TAX - 5 PAYERS, THE PROPOSITION OF THE ISSUANCE OF $ GENERAL OBLIGATION LIBRARY BONDS OF SAID CITY, AND PROVIDING FOR THE 6 ISSUANCE OF SUCH BONDS IN THE EVENT THEY ARE VOTED AT SUCH ELECTION. 7 WHEREAS, the construction and furnishing of a public 8 building for use as a municipal public library, and the acquisition 9 of a building site therefor, is considered by the City Council of 10 the City of Caldwell to be necessary and essential to the health 11 and well -being of the inhabitants of said city; and 12 WHEREAS, said city does not have funds available to pay 13 the cost of the foregoing and has determined it advisable to All 14 finance such cost through the issuance of the bonds of the city 15 pursuant to the provisions of Chapter 28 of Title 50 of the Idaho 16 Code, and in order to do so desires to provide for the holding of w� U 17 the election required by said chapter; and i� 18 WHEREAS, this City Council has, by Ordinance Number 1069, 19 adopted this day, called an election for ley 10, 1966 to determine 20 the issuance of $168,425.00 General Obligation Fire Station Bonds 21 and it is desired to hold the election on the aforementioned bonds 22 for library purposes at the same time and places as the election on 23 the bonds for fire station purposes; 24 NOW, THEREFORE, BE IT ORDAINED By the M yor and City 25 Council of the City of Caldwell, Canyon County, Idaho, as follows: 2 Section 1. That a special election is hereby called to 27 be held in the City of Caldwell on May 10, 1966 at the same time 28 and places as the election called by this City Council on the 29 issuance of $168 General Obligation Fire Station Bonds pur- 30 suant to Ordinance Number 1069 this day adopted, for the purpose 31 of submitting to the qualified electors of said city who are tax- 32 payers of said city the following proposition: 1 QUESTION: Shall the City of Caldwell, Idaho, issue and sell its negotiable coupon general 2 obligation bonds to the amount of $231,575.00, for the purpose of providing funds with which 3 to construct and furnish a public building for use as a municipal public library, and to acquire 4 a building site therefor, in and for said city, as more fully provided in Ordinance Number 1070 5 adopted on March 30, 1966? 6 Section 2. That the polls at said election shall open 7 at the hour of 12:00 o'clock Noon and remain open continuously 8 until the hour of 8:00 o'clock P. M. and then close. Said election 9 shall be held at the polling places specified in the form of elec- 10 tion notice set out in Section 4 of said Ordinance Number 1069. 11 Section 3. That all persons who at the time of the 12 election are qualified electors of the city and who are taxpayers 13 thereof, properly registered and possessing the qualificiations of ° 14 residents, shall be qualified to vote at said election, and that 15 the ballots to be used at said election shall be in substantially 16 the form set out in Section 3 of said Ordinance Number 1069 calling 17 an election on said General Obligation Fire Station Bonds. 0 18 Section 4. That notice of said election shall be given 19 as provided in Section 4 of said Ordinance Number 1069. 20 Section 5. That if at said bond election two - thirds of 21 the qualified electors of the city who are taxpayers of the city 22 voting thereat assent to the issuance of said General Obligation 23 Fire Station Bonds, such bonds of the city shall be issued as here - 24 inabove provided and shall mature over a period commencing at the 25 expiration of one Year from their date and ending twenty years from 26 their date, and shall bear interest at a rate or rates not in excess 27 of six per cent 0%) per annum, and shall be payable in accordance 28 with the provisions of Section 50 -2811, Idaho Code and the Municipal 29 Bond Law of Idaho. 30 Section 6. That the persons named in Section 6 of said 31 Ordinance Number 1069 are hereby appointed to act as judges and 32 clerks and constables of said election. ATTEST: r , I�Qlty cleric 29 I Section 7. That said bonds shall be issued if carried 2 as aforesaid, and payment shall be made through the levy of taxes 3 on all taxable property in the City of Caldwell, beginning with the 4 year 1966 and continuing until principal and interest shall have 5 been fully paid, in such amounts and at such rates as are necessary 6 to assure the prompt payment of such principal and interest, and 7 it is hereby ordered that such taxes shall be levied annually at 8 the time and in the manner the general taxes for said city are 9 levied in each such year, in addition to all other authorized taxes 10 and assessments. The proper officer or officers of said city are 11 hereby authorized and directed to do all things requisite and nec- 12 essary to carry out the provisions of this section and to apply 13 the proceeds of the taxes so collected to the payment of such a s o ll 14 principal and interest. o 9 ed 15 Section S.
