BY COUNCILMAN HANKS
AN ORDINANCE AMENDING CHAPTER 7 OF TITLE IV OF THE CITY CODE OF THE
CITY OF CALDWELL, IDAHO, ADDING THERETO SECTION 4 -7 -13, PROVIDING
FOR THE RIGHT OF THE COUNCIL TO REFUSE APPLICATIONS FOR BEER
LICENSES IN THE EVENT THE APPLICANT DOES NOT PROVIDE THE COUNCIL
WITH COMPETENT EVIDENCE OF APPLICANT'S QUALIFICATIONS UNDER THE
PROVISIONS OF CHAPTER 10 OF TITLE 23 OF THE IDAHO CODE AND THIS
CHAPTER OF THE CITY CODE, AND ADDING SECTION 4 -7 -14 PROVIDING FOR
THE REVOCATION OR CANCELLATION OF ANY BEER LICENSE UPON VIOLATION
BY THE LICENSEE OR LICENSEE'S EMPLOYEES OF THE PROVISIONS OF CHAP-
TER 10 OF TITLE 23 OF THE IDAHO CODE AND THIS CHAPTER OF THE CITY

Be it ordained by the Mayor and Council of the City of

Section 1. That Chapter 7, Title IV, of the City Code
is hereby amended by adding thereto Section 4 -7 -13 to read as
follows:
"4 -7 -13: REFUSAL OF LICENSE: The Council reserves the
right to refuse any and all applications for beer licenses in the
event that the applicant does not provide the Council with competent
evidence that the applicant possesses all of the qualifications and
none of the disqualifications for a license under the provisions
of Chapter 10 of Title 23 of the Idaho Code or the provisions of
this chapter of the City Code."
Section 2. That Chapter 7, Title IV, of the City Code
Is hereby amended by adding thereto Section 4 -7 -14 to read as
follows :
91 4 -7 -14: REVOCATION OF LICENSE: The right is hereby
vested in the Council to revoke or cancel any beer license at any-
time for violation of the provisions of Chapter 10 of Title 23 of
the Idaho Code or the provisions of this chapter of the City Code
by the licensee or licensee's employees."
Section 3. This ordinance shall be in full force and
effect from and after its approval, passage and publication, as
required by law.
