ORDINANCE NO. 1052
BY COUNCILMAN DAVENPORT
AN ORDINANCE AMENDING SECTION 4 -13 -1 OF CHAPTER 13 OF TITLE IV OF
THE CITY CODE OF THE CITY OF CALDWELL MAKING IT UNLAWFUL FOR ANY
PERSON TO OPERATE A CARD ROOM WITHOUT FIRST HAVING OBTAINED A LIC-
ENSE THEREFOR AND ELIMINATING THE LICENSING OF PIGEON HOLE TABLES;
ADDING TO CHAPTER 13 OF TITLE IV OF THE CITY CODE OF THE CITY OF
CALDWELL, SECTION 4 -13 -4 PROVIDING THAT APPLICATIONS FOR BILLIARD,
POOL, BAGATELLE OR CARD ROOM LICENSES MAY BE DENIED BY THE CITY
COUNCIL OF THE CITY OF CALDWELL IF IN THE OPINION OF THE COUNCIL THE
LICENSING OF SAID CARD ROOM IS NOT FOR THE GENERAL WELFARE OF THE
CITY.

Be it ordained by the Mayor and Council of the City of
Caldwell, Idaho:
Section 1. That Chapter 13, Title IV, Section 4 -13 -1 of

Should a license be denied under the provision of this

telle hall or card room open to the public without first obtaining

a license therefor."
i8 Section 2. That the following is hereby adopted as
19 Section 4 -13 -4 of Chapter 13, Title IV, of the City Code of Caldwell,

Idaho, to -wit:
211, "4 -13 -4: As a condition to the granting of billiard,
22
pool, bagatelle or card room licenses, the Council of the City of
23 Caldwell, shall have the privilege of denying any application for
241 license if in the opinion of the Council that the granting of said
section, the applicant may appeal to the Council for a hearing on
the same. The decision of the Council after said hearing shall be
final with respect to the granting or refusing of said license.
