AN ORDINANCE AMENDING SECTION 6 -3 -2 OF CHAPTER 3, TITLE VI OF THE
CITY CODE OF CALDWELL, IDAHO, REGARDING THE PERMITTED USES IN THE
"AB" RESIDENCE ZONE AS THE SAME PERTAINS TO DWELLINGS AND APART-
MENT HOUSES BY REQUIRING SPECIAL PERMITS FOR DWELLINGS OR APART-
MENT HOUSES CONTAINING FOUR OR MORE FAMILY UNITS, PROVIDING AN
EFFECTIVE DATE FOR THIS ORDINANCE TO TAKE EFFECT, AND REPEALING
ALL ORDINANCES IN CONFLICT THEREWITH.

Be it ordained by the Mayor and Council of the City of
Caldwell, Idaho:
Section 1. That Chapter 3, Title VI, Section 6 -3 -2,
paragraph (A) of the City Code of Caldwell, Idaho, is hereby amend-
ed to read as follows:
"(A) Classified
1. Dwellings - single, double and
triple family units
2. Lodging Houses
3. Boarding Houses
4. Apartment Houses, not exceeding
three family units
5. School, Public and Private
6. Colleges
7. Libraries
S. Museums
9. Armories
10. Courthouses
11. Parks and Playgrounds
12. Fire Stations built in residence
style
13. Farming
14. Truck Gardening"

I Section 2. That Chapter 3, Title III, Section 6 - - of
2 the City Code of Caldwell, Idaho, is hereby amended by adding para-
3 graph (I) thereto, to read as follows:
4 "(I) Dwellings or apartment houses containing four or more
5 family units: Dwellings or apartment houses with more than four or
6 more family units, by special permit of the Board of Adjustment
7 after a public hearing, with the further provision that for dwell -
8 ings or apartments with twelve (12) or more family units, before
9 the issuance of said special permit and prior to the public hearing
10 thereon, there shall be on file in the office of the Building Inspec-
11 for the written consent of sevent five
, y- per cent (75%) of the area
12 of all the property within a radius of three hundred (300) feet, of
13 any part of the premises upon which said dwelling or apartment
14 houses of twelve (12) or more family units are to be located."
15 Section 3. All ordinances, resolutions, orders, or parts
16 therewith, in conflict herewith are hereby repealed, rescinded and
1711 annulled.
18 Section 4. This ordinance shall be in full force and
19 effect from and after its approval, passage and publication, as
sc required by law.
