AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF AND OWNERS OF PROPERTY
IN THE CITY OF CALDWELL, AN APPLICATION HAS BEEN PRESENTED FOR THE
VACATION OF ALL THAT PORTION OF AIRPORT AVENUE IN THE SOUTHEAST
QUARTER OF SECTION 21, TOWNSHIP 4 NORTH, RANGE 3 WEST OF THE BOISE
MERIDIAN, ADJACENT AND WESTERLY OF LOTS 1, 15, 28 34 AND 35 of IN-
DUSTRIAL SITE ADDITION TO THE CITY OF CALDWELL AS OF RECORD AND ON
FILE IN THE OFFICE OF THE COUNTY RECORDER OF CANYON COUNTY, IDAHO;
PROVIDING FOR FILING OBJECTIONS THERETO AND FOR FILING CLAIMS FOR
DAMAGES SUSTAINED THEREBY; PROVIDING FOR ASCERTAINING SUCH DAMAGES
FOR THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL; AND PROVIDING
FOR THE PUBLICATION OF THIS ORDINANCE.
10 BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, IDAHO:

12 Section 1. That an application has been presented to
13 the Mayor and Council of the City of Caldwell, for the passage and
a� 14 approval of an ordinance vacating all that portion of Airport Avenue

aa 15 in the Southeast Quarter of Section 21, Township 4 North, Range 3
16 West of the Boise Meridian, adjacent and Westerly of Lots 1, 15, 28,
17 34 and 35 of Industrial Site Addition to the City of Caldwell as of

18 record and on file in the Office of the County Recorder of Canyon
19 County, Idaho, more particularly described as follows:
20� Commencing at the Northwest corner of the Southeast Quarter
of Section 21, Township 4 North, Range 3 West of the Boise
21 Meridian, thence Southerly on the West line of the Southeast
Quarter of said Section 21 a distance of 620.2 feet to the
22 true point of beginning. Thence Easterly 34.08 feet to the
Northwest corner of Lot 1, Industrial Site Addition to the
23,, City of Caldwell as of record and on file in the Office of
I the County Recorder of Canyon County, Idaho; thence Southerly
241 on the West line of said Lot 1 a distance of 217 feet to the
Southwest corner of said Lot 1; thence Westerly 34.08 feet to
26 the West line of the Southeast Quarter of said Section 21;
thence Northerly on the West line of the Southeast Quarter of
26 said Section 21 a distance of 217 feet to the true point of

2 of Section 21, Township 4 North, Range 3 West of the Boise
Meridian, thence Southerly on the West line of the Southeast
30 Quarter of said Southwest Quarter a distance of 944.7 feet

Thence Easterly a distance of 34.08 feet to the Northwest
corner of Lot 15 of the Industrial Site Addition to the City
of Caldwell, as of record and on file in the Office of the
County Recorder of Canyon County, Idaho; thence Southerly
along the West line of Lots 15, 28, 34 and 35 a distance of
634.01 feet to the Southwest corner of Lot 35 of said Indus-
trial Site Addition; thence Westerly 34.08 feet to the West
line of Southeast Quarter of said Section 21; thence Northerly
on the West line of the Southeast Quarter of said Section 21
a distance of 634 .01 feet to the true point of beginning.

perty abutting and adjacent to said above described avenue.

Section 2. That said application will be considered

under a suspension of the requirement that an Ordinance be read on
11
three different days at a meeting of the Council of the City of
12
Caldwell to be held on the 18th day of January, 1965, at the hour of
13
8 :00 o'clock P. M., at the Council Chambers in the City Hall in the
City of Caldwell; when and where or prior to which date, any citizen

of the City of Caldwell or any owner of property in the City of
Ax

Caldwell may file with the Clerk of the City of Caldwell written
17
objections to granting said application or may file any claim for

18
damages which any such citizen or owner of property may sustain by
19
reason of the vacation of said avenue, and all claims for damages

will be considered and ascertained by the Council of the City of

Caldwell at said meeting.

Section 3• Notice of the foregoing shall be given to

all citizens of, and owners of property in the City of Caldwell,

Idaho, by the publication of this Ordinance in The News - Tribune,

a newspaper published in the City of Caldwell, Idaho, in at least
26
one issue thereof and commencing with the issue published on the
27
9th day of January, 1965.
