AN ORDINANCE GRANTING TO THE OREGON SHORT LINE RAILROAD COMPANY
(UNION PACIFIC RAILROAD COMPANY, LESSEE), ITS SUCCESSORS AND ASSIGNS
THE RIGHT TO CONSTRUCT, OPERATE AND MAINTAIN A STANDARD GAUGE RAIL-
ROAD INDUSTRY TRACK OVER AND ACROSS AN ALLEY AND AN UNNAMED STREET
LYING NORTHERLY OF AND ADJACENT TO THAT CERTAIN PARCEL OF LAND
DEEDED TO THE STATE OF IDAHO DESCRIBED IN THE RECORDS OF CANYON
COUNTY, IDAHO IN BOOK 187 OF DEEDS, PAGE 556, AS DOCUMENT NO.
348o96 IN THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION
21, TOWNSHIP 4 NORTH, RANGE 3 WEST OF THE BOISE MERIDIAN, IN THE
CITY OF CALDWELL, CANYON COUNTY, STATE OF IDAHO.
Be it ordained by the Mayor and City Council of tin City

of Caldwell, Canyon County, Idaho:
Section 1. That there is hereby granted to the Oregon
Short Line Railroad Company (Union Pacific Railroad Company, Lessee)
its successors and assigns, the right to construct, operate and
maintain said spur track across that certain 20 -foot alley lying
Northerly and adjacent to that certain parcel of land deeded to
the State of Idaho described in the records of Canyon County, Idaho
in Book 187 of Deeds, Page 556, as Document No. 348096 in the North-
east Quarter of the Southwest Quarter of Section 21, Township 4
North, Range 3 West of the Boise Meridian, in the City of Caldwell,
Canyon County, Idaho, along the following described center line,
to -wit;
Beginning at a point in the North line of said
alley, also the Southerly right of way line of
the Oregon Short Line Railroad Company, that is
87.6 feet distant South from the Center line of
the main track of the Wilder Branch of said Rail-
road Company as now constructed and operated,
measured along a straight line drawn at right
angles thereto from a point thereon that is
523 .54 feet distant East from the West line of
said Northeast Quarter of the Southwest Quarter
of Section 21, measured along said center line
of main track;
Thence Southeasterly along a line curving to the
30 right, having a radius of 383 .065 feet, a dis-
tance of 30.55 feet, more or less, to a point in
31 the Southerly line of said alley that is 79.7
32 feet, more or less, distant West from the North-
east corner of that certain parcel of land deeded

Page 556 records of Canyon County, Idaho.
Section 2. That there is hereby granted to the Oregon
Short Line Railroad Company (Union Pacific Railroad Company, Lessee
its successors and assigns, the right to construct, operate and
maintain said spur track across that certain unnamed street 37.75
feet wide lying Easterly of and adjacent to that certain parcel of
land deeded to the State of Idaho described in the records of Canyo:
County, Idaho in Book 187 of Deeds, Page 556, records of Canyon
County, Idaho in said Northeast Quarter of the Southwest Quarter of
1111 Section 21, in the City of Caldwell, along the following described
center line, to -wit:

Beginning at a point in the East line of said
parcel of land deeded to the State of Idaho
described in the records of Canyon County,
Idaho in Book 187 of Deeds, Page 556, records
of Canyon County, Idaho that is 104.7 feet,
more or less, distant South from the Northeast
corner of said parcel;
17 Thence Southeasterly along a line curving to
the right, having a radius of 383 .065 feet in
18 a distance of 114.6 feet, more or less, to a
point in the East line of said unnamed street
19 that is 212.8 feet, more or less, distant South
from the Easterly extension of the North line
20 of said parcel of land deeded to the State of
Idaho described in the records of Canyon County,
21 Idaho in Book 187 of Deeds, Page 556, records
of Canyon County, Idaho.
Section 3. That the right to construct, operate and
maintain a standard gauge railroad industry spur track across the
alley and unnamed street as provided in Sections 1 and 2 of this
ordinance is conditioned on the Oregon Short Line Railroad Company
(Union Pacific Railroad Company, Lessee), its successors and assig
that said company will provide a suitable crossing of the width as
shall be designated by the City Engineer of the City of Caldwell
for vehicular traffic over said spur track at the points in which
said spur track crosses said alley and unnamed street.
Section 4. That this ordinance shall take effect and
