7 AND THAT NO CLAIM OR CLAIMS FOR DAMAGES WHICH WOULD BE SUSTAINED BY

OWNERS; DETERMINING THAT NO DAMAGE WILL BE SUSTAINED BY ANY CITIZEN

18 Be it ordained by the Mayor and Council of the City of
19 Caldwell, Idaho:
20 Section 1. That by Ordinance No. 1030, passed by the
21 Council and approved by the Mayor of the City of Caldwell, Idaho,
2 on the 25th day of June, 1964, and published in The News - Tribune,
231 newspaper published in the City of Caldwell, Idaho, in one issue
24 thereof on the 27th day of June, 1964, notice was given to all citi-
25 zens and owners of property in the City of Caldwell, Idaho, that an
26 application has been presented to the Mayor and Council of the City
27 of Caldwell requesting the passage and approval of an ordinance
28 vacating the Southeasterly 150 feet of the alley in Block 5, as
29 numbered and designated on the Revised Map of Caldwell, Idaho,
30 filed July 29, 1891, at 3:00 o'clock P. M. and now of record in
31 Book 1 of Plats, page 20, records of Canyon County, Idaho, which
321 ordinance provided the manner for filing claims for damages which
ill would be sustained by the vacating of the Southeasterly 150 feet
of the alley in Block 5 above described.
Section 2. That no objections to the granting of said

application have been made or filed and no claim or claims for
511 damages which would result therefrom; and it is hereby determined
that no citizen of or owner of property of the City of Caldwell,
Idaho, will be damaged or injured by the vacation of the Southeast-
erly 150 feet of the alley in Block 5, as numbered and designated
on the Revised Map of Caldwell, Idaho, filed July 29, 1891, at
3:00 o'clock P. M. and now of record in Book 1 of Plats, Page 20,
records of Canyon County, Idaho, and that it is in fact to the
best interest and advantage of the City of Caldwell, Idaho, and

its citizens and its property owners that the above described
Southeasterly 150 feet of the alley in Block 5 be vacated.
Section 3. Be it ordained and established that the
Southeasterly 150 feet of the alley in Block 5, as numbered and
17 designated on the Revised Map of Caldwell, Idaho, filed July 29,
18 1891, at 3:00 o'clock P. M. and now of record in Book 1 of Plats,
1911 Page 20, records of Canyon County, Idaho, from and after the passage 4
20 11 approval and publication of this ordinance, shall be vacated, and
that the said Southeasterly 150 feet of the alley in Block 5 shall
no longer be open or subject to the use of the public; and there-
upon the title to said Southeasterly 150 feet of the alley in Block
5, as numbered and designated on the Revised Map of Caldwell, Idaho,
filed July 29, 1891, at 3:00 o'clock P. M. and now of record in
2 611 Book 1 of Plats, Page 20, records of Canyon County, Idaho, shall
pass and revert to the persons dedicating the same or their succes-
sors, heirs and assigns, free of all easement and dedication hereto-
fore existing for a public alley therein.
Section 4. It appearing that no claim or claims for
damages sustained by any citizen or citizens of the City of Caldwell
Idaho, or by any owner or owners of property therein, by reason of

the vacation of the Southeasterly 150 feet of the alley in Block 5
has been filed or made, it is hereby determined that no damages
will be sustained by the citizens of or owners of property in the
City Of Caldwell, Idaho, by reason of the vacation Of said South -
easterly 150 feet of the alley in Block 5 above described.
Section 5. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
PASSED By the Council of the City of Caldwell, this 6th
day of July, 1964.
APPROVED By the Mayor of the City of Caldwell, this 6th
day of July, 1964.
