ORDINANCE NO. 1019
BY COUNCILMAN XAR.TIN
AN ORDINANCE RECITING THAT A PUBLIC HEARING HAVING BEEN HELD
AFTER DUE NOTICE PURSUANT TO LAW, AND THAT THE COUNCIL OF THE
CITY OF CALDWELL, IDAHO, BY NOT LESS THAN THREE - FOURTHS VOTE OF
THE COUNCIL, HAS DETERMINED THE ADVISABILITY OF ALTERING, AMEN-
DING AND CHANGING THE ZONE REGULATIONS OF THE CITY OF CALDWELL
BY ALTERING THE BOUNDARIES OF VARIOUS ZONES, REPEALING ALL ORD-
INANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVID
FOR THE PUBLICATION OF THIS ORDINANCE AND ITS TAKING EFFECT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO, as follows:
Section 1. That, pursuant to resolution of the Mayor and
Council of the City of Caldwell, Idaho, notice of time and place
of a hearing was published in the News- Tribune, a newspaper
published in the City of Caldwell, Idaho, in two issues thereof,
Dated October 26 and November 2, 1963, which said notice provided
for a hearing on the Gish day of November, 1963, at the hour of
8:00 o'clock p.m., where objections could be made to the alter-
ations of the various boundaries of the City of Caldwell.
Section 2. That said hearing having been duly and
held, as provided in said notice, and more than three - fourths of
the members of the City Council approving the alterations and
changes as set forth in said notice;
Section 3. NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED,
That the various changes of the City of Caldwell be and the same
is hereby altered and amended by altering the boundaries of
various zones of the City of Caldwell, as follows:
(A) That the "E" Industrial Zone be enlarged by adding
thereto the following described property:
BEGINNING at a point on the West line of South Georgia
Avenue which is 600 feet Northeasterly and perpendicular
to the Northeast right -of -way line of Cleveland Boulevard;
thence Southeasterly and parallel at a distance of 600
feet from the Northeast right -of -way line of Cleveland

(C) That the "B" District of the A -B Residential Zone
be enlarged by adding thereto the following described
property:
TRACT 1:
Beginning at the intersection of the center lines of
South Georgia Avenue and Linden Street, being the North-
west corner of the Northeast Quarter of the Northwest
Quarter of Section 35, Township 4 North, Range 3 West
of the Boise Meridian; thence South along the center
line of South Georgia Avenue to the Southwest corner of
the Southeast Quarter of the Northwest Quarter of said
Section 35; thence East to the Southeast corner of the
Southeast Quarter of the Northwest Quarter of said
Section 35 which point is on the center line of Florida
Avenue; thence North along the center line of Florida
Avenue to its intersection with the center line of
Beech Street which point is the Northeast corner of the
Southeast Quarter of the Southeast Quarter of the North-
west Quarter of said Section 35; thence Easterly along
the center line of Beech Street and the center line of
Beech Street extended to its intersection with the center
line of the Wilson Slough Drain (also known as Elijah
Drain) right -of -way; thence North 16 West along
said center line of Wilson Slough Drain to a point which
is 131.9 feet Southwesterly and perpendicular to the
center line of Cleveland Boulevard, as shown on the
official plat of Nicol - Farwell Addition to the City of
Caldwell on file and of record in the office of the
Recorder of Canyon County, Idaho; thence Westerly to
the South corner of Lot 7 of Lafferty's Addition to the
City of Caldwell as shown on the official plat thereof
on file and of record in the office of the Recorder of
Canyon County, Idaho; thence Northwesterly along the
Southwesterly line of Lots 7, 8, 9 and of Lot 1 of said
Lafferty's Addition to the Southeast corner of Lot 2 of
said Lafferty's Addition; thence Northerly on the East
line of said Lot 2 to the Northeast corner of said Lot 2;
thence Westerly to the intersection of the center lines
of Florida Avenue and Cherry Street; thence Northerly
on the center line of Florida Avenue to a point 345
feet Southwesterly and perpendicular to the center line
of Cleveland Boulevard; thence Northwesterly and parallel
at a distance of 345 feet from the center line of
Cleveland Boulevard to the center line of Linden Street;
thence Westerly on the center line of Linden Street to
the point of beginning.
TRACT 2:
Beginning at a point 115 feet East of the Northwest
corner of Section 34, Township 4 North, Range 3 West of
the Boise Meridian, on the North line of said Section 34;
thence South and parallel to the West line of said
Section 34, 242 feet; thence East and parallel to the
North line of said Section 34, 180 feet; thence South
and parallel to the West line of said Section 34, 88
feet; thence East and parallel to the North line of said

Boulevard to the center line of Ustick Road, being the
South line of Section 36, Township 4 North, Range 3
West of the Boise Meridian; thence Easterly on the
center line of Ustick Road to its intersection with the
Southwesterly right -of -way line of the Union Pacific
Railroad; thence Northwesterly along the Southwesterly
right -of -way line of the Union Pacific Railroad to its
intersection with the West line of South Georgia Avenue
extended; thence Southerly along the West line of South
Georgia Avenue to the point of beginning.
(B) That the "C. D. Commercial Zone be enlarged by
adding thereto the following described property:
BEGINNING at a point on the West line of South Georgia
Avenue which is 600 feet Northeasterly and perpendicular
to the Northeast right -of -way line of Cleveland Boulevard;
thence Southeasterly and parallel at a distance of 600
feet from the Northeast right -of -way line of Cleveland
Boulevard to the center line of Ustick Road, being the
South line of Section 36, Township 4 North, Range 3 West
of the Boise Meridian; thence Westerly on the center line
of Ustick Road to its intersection with the center line
of Lake Avenue which point is the Southwest corner of
said Section 36; thence Northerly on the center line of
Lake Avenue 1245.0 feet to the center line of the Wilson
Slough Drain (also known as the Elijah Drain) right -of-
way; thence North 89 ° 57' West, 622.8 feet; thence North
36 ° 48' West, 1321.9 feet; thence North 16 0 38' West,
1216.8 feet; thence Westerly to the South corner of Lot
7 of Lafferty's Addition to the City of Caldwell as
shown on the official plat thereof on file and of record
in the office of the Recorder of Canyon County, Idaho;
Thence Northwesterly along the Southwesterly line of
Lots 7, 8, 9 and of Lot 1 of said Lafferty's Addition
to the Southeast corner of Lot 2 of said Lafferty's
Addition; thence Northerly on the East line of said
Lot 2 to the Northeast corner of said Lot 2; thence
Westerly to the intersection of the center lines of
Florida Avenue and Cherry Street; thence Northerly on
the center line of Florida Avenue to a point 345 feet
Southwesterly and perpendicular to the center line of
Cleveland Boulevard; thence Northeasterly and parallel
at a distance of 345 feet from the center line of
Cleveland Boulevard to the center line of Linden Street;
thence Westerly on the center line of Linden Street to
the Southwest corner of the Southwest Quarter of the

Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.

Section 5. This ordinance shall be in force and take
effect from and after its passage, approval and publication.
