ORDINANCE NO. 1003
BY COUNCILMAN SMITH
AN ORDINANCE RECITING THAT A PUBLIC HEARING HAVING BEEN HELD
AFTER DUE NOTICE PURSUANT TO LAW, AND THAT THE COUNCIL OF THE
CITY OF CALDWELL, IDAHO, BY THREE - FOURTHS VOTE OF THE COUNCIL,
HAS DETERMINED THE ADVISABILITY OF ALTERING, AMENDING AND
CHANGING THE BOUNDARIES OF THE "C.D." COMMERCIAL ZONE OF THE
CITY OF CALDWELL, IDAHO, REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING FOR THE PUBLICA-
TION OF THIS ORDINANCE AND ITS TAKING EFFECT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO, as follows:
Section 1. That, pursuant to resolution of the Mayor and
Council of the City of Caldwell, Idaho, notice of time and plac
of a hearing was published in the News- Tribune, a newspaper
published in the City of Caldwell, Idaho, in two issues thereof
dated March 7 and March 16, 1963, which said notice provided
for a hearing on the 1st day of April, 1963, at the hour of
8:00 o'clock p.m., where objections could be made to the
alteration of the boundaries of the "C. D." Commercial Zone of
the City of Caldwell,
Section 2. That said hearing having been duly and regularl
held, as provided in said notice, and more than three - fourths
of the members of the City Council approving the alterations
and changes of the "C.D." Commercial Zone, as set forth in
said notice;
Section 3. NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED,
That the "C.D." Commercial Zone of the City of Caldwell be
and the same is hereby altered and amended by adding thereto
those parts of the City of Caldwell, Idaho, within the
following boundaries:

Beginning at the intersection of the South boundary
line of Maple Street and the Southwesterly boundary
line of Cleveland Boulevard in the City of Caldwell,
Idaho; thence West along the South boundary line of
Maple Street 400 feet; thence South and parallel with
the East boundary line of the Southeast Quarter of the
Southwest Quarter of the Southwest Quarter of Section
26, Township 4 North, Range 3 West, Boise Meridian to
the South line of said Southeast Quarter of the South-
west Quarter of the Southwest Quarter; thence East to
the Southeast corner of said Southeast Quarter of the
Southwest Quarter of the Southwest Quarter; thence
North along the East boundary line of said Southeast
Quarter of the Southwest Quarter of the Southwest
Quarter to its intersection with the Southwesterly
boundary line of Cleveland Boulevard; thence North-
westerly along the Southwesterly boundary line of
Cleveland Boulevard to the point of beginning, except-
ing any part of the above tract which is within 120
feet of the Southwesterly boundary line of Cleveland
Boulevard.

Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5. This ordinance shall be in force and take effect
from and after its passage, approval and publication.
PASSED By the Council this 1st day of April, 1963.
APPROVED By the Mayor this 1st day of April, 1963.
