On Roll Call the following Councilmen tnswered present: Oakes, Boynton, Fenrich amford, Hollingsworth and Montgomery. Absent: None, The Mayor informed the Council that the Meeting was called to take up unfinished Whereupon, Montgomery moved the adoption of the following preamble and resclutic oh he presented to the Mayor and Council, which motion was duly seconded by Mumford: =1J i i wIHEREAS, by Ordinance No, 530 of the City of Caldwell, Idaho, entitled, 11 An RESOLUTION. BE IT RESOLVED that the biayor the City of be and he is hereby auth- ,C,,aaldwell orized to appoint a committee of three to investigate and find a location for a Municig _pal Ice Skating Pond within the City of Caldwell and that the said Co.anittee have power to act and upon finding a suitable location to establish said skating pond. Whereupon the Mayor appointed the following committee: Councilmen, Oakes HollBngs f worth and Boynton. Thereupon, Councilman Hollingsworth, introduced Bill No 13, proposed Ordinance No. 530, by Hollingsworth, entitled: AN ORDIN.iNCE CREATING, ESTABLISHING, LA OUT, OPENING, WIDENING, AND IMPROVING A STREET, ROAD, .'.D:GHWAY, OR AVENUE IN THE CITY OF CALDWELL, C :,NYO11 COUNTY, STATE OF IDAHO, TO BE KNOWN AS THE "NORTH CALMIELL STOCK TRAIL:" PROVIDING FOR THE TAKING OF PRO- PERTY FOR PUBLIC USE, ALONG SAID STREET, ROAD, HIGHWAY, OR AVF WE, WHERE NECESSARY; PROVIDING FOR THE PA - LIENT OF COMPENSATION FOR PRIVATE PROPERTY TAKEN OR INJURED BY SUCH STREET, ROAD, HIGHWAY, OR AVENUE; ADM PROVIDING FOR THE ELECTIOPI AND COMPENSATION OF FIVE DISINTERESTED HOLDERS, WHO SHALL FIdTEFULLY AND IMPARTIALLY ASSESS DAMAGES OR INJURY TO PROPERTY TAKEN OR INJURED; PROVIDING FOR AN OATH TO BE SUBSCRIBED AND 871ORN TO BY THE FIVE SO ELECTED; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINAPTES IN CONFLIC HEREWITH. which was read for the first time and the Council proceeded to a consideration of Bill No. 13. It was moved by Mumford, seconded by Fenrich that the rules requiring that the reading of a bill on three separate days be suspended and that Bill No. 13, be ret.d the second time by title and the third time in full, section by section and placed on its final passage, The Mayor directed the Clerk to call the roll on the motion with the following results: i Thosevoting in the affirmative were: Oakes, Boynton, Fenrich, Mumford, Nollingsworth and Montgomery. Those voting in the negative: None. Absent and not voting. None. The Mayor .t a', declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No. 13, the second time by title and the third time in full, section by section. The Clerk read the Bill as directed. The question then being "Shall Bill No. 13 pass ?" The Mayor directed the Clerk to call the roll on the above question which_result- ed as follows: Those voting in the affirmative were: Oakes, Boynton, Mu�iford, Men rich, Hollingsworth and iront�;omery. Those voting in the negative. None. Absent and not vot- ing: None. Thereupon, the Mayor declared Bill No. 13, had passed, and the Mayor in open session of the Council duly signed and approved the_Bill, and the Clerk duly signed end attested the same which became Ordinance 530. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance 530 to be published in the Caldwell News- Tribune, the official newspaper of the City of Caldwell, Idaho. Absent: None, The Mayor informed the Council that the Meeting was called to take up unfinished Whereupon, Montgomery moved the adoption of the following preamble and resclutic oh he presented to the Mayor and Council, which motion was duly seconded by Mumford: =1J i i wIHEREAS, by Ordinance No, 530 of the City of Caldwell, Idaho, entitled, 11 An yo Ordinance creating, establishing, laying out, opening, widening, and improving a street, road, highway, or'avenue in the City of Caldwell, Canyon .County, State of Idaho, to be known as the "North Caldwell Stock Trail;" providing for the taking of property for public use,.along said street, road, highway, or avenue, where necessary; providing for the paymen -- of compensation for private property taken or injured by such street, road, highway, or avenue; and providing for the election and conpensation of five disinterested holders, who shall faithfully and impartially assess damages or injury to property taken or injured; broviding for an oa'_h to be subscribed and sworn to by the five so elected; and repealing a110rdinanees or parts of Ordinances in c,nflict herewith," providing for the election of Pive'disinterested persons to appraise the damage and injury, if any, to private property across or over which said street, road, highway, or avenue, known as the "North Caldwell took Trail," as provided by said Ordinance, shall pass; and - WHEREAS, it is necessary that five disinterested persons, as provided in said rdlnance, should be elected to assess the damage and injury, if any, to private property L ver'which said street, road, highway, or avenue, shall pass, for the reason that some of he land owners can not otherwise be settled with, NOW, THERFWORE, upon nomination by the Mayor of Caldwell, Canyon County, Idaho, be it' resolved, and this does resolve, that John W. Smeeq,Joe Dickens, W. T. Kimbrough, R. C. Pasley, and J. A. Miller, be, and they are hereby elected as five disinterested per - one to appraise and assess the damage to private property necessitated by the opening, idening, establishing, creating laying out, and improving, said street, road, highway, or venue, and across which the same shall pass, and is taken by the City of Caldwell for the urpose of said improvement, and in accordance with the provisions of'said Ordinance, and L BE IT FURTk1ER RESOLVED, That the Mayor and City Clerk of the City ofnCaldwell be, nd they are, hereby authorized and directed to issue a certificate of election to the said arsons so elected, with the seal of the City attached. There being no further business to come before the Council, it was on motion duly econded and carried declared adjourned. Mayor City Glerk COUNCIL C!"PRO f.1IP" 6, 1930. _ The Regular Monthly Meeting of the City Council me t in the Council Room of the City Hall, with the Mayor Emery L. Vassar, presiding. On Roll Call the following Councilmen answered present: Edgar L. Oakes, F. D. Mumford, VP. S. Boynton, G. W. Montgomery, G. M. Fenrich and W. R. Hollingsworth. The Minutes of December 2nd, 16th., and 30th., were rd-d and approved as read. The Committee appointed to investigate the converting of Lots 1 to 10 , Block 10, College Heights into average reported that a resolution had bee passed several ago prohibiting the converting of lots to average. The Bills for December were read and on motion made by 1. Oakes, secogded by Eenxicb;' that these bills be allowed and Warrants be ordered drawn for the various amounts all of which had been approved by the Chairman of the Finance Committee. Motion carried. i
