The couhcil met on Call or the kayor, with the Mayor 'fhurlow Bryant presiding.
On Roll Call the following Councilmen answered present; J: Randall Sloop, F. E.
Newman, 0. L. Thornock and E.R.Frasher. Absent; John Finck and Pete Clasen.
The Mayor informed the Council that this is the time set by statute for fixing
assessments of the Caldwell Municipal Irrigation System for the year 1944.
Thereupon the following Resolution was presented to the Mayor and,Council by
Councilman Newman;
RESOLUTION FIXING ASSESStJCF.NTS
OF
THE CALDWELL MUNICIPAL IRRIGATION SYSTEM
for the year 1944.
WHEREAS, this is the time provided by statute for levying an assessment of the
necessary funds for expenses of maintaining, operating, ;improving, extending and enlarging
the water works and system of "The Caldwell Municipal Irrigation System ", for the ensuing
calendar year, upon the lands within said "The Caldwell Yunicipal Irrigation System ", in
accordance with the benefits accruing to such lands by reasoh of the operation and main-
tenance of the works of said irrigation system, and which said assessment shall include a
reasonable sum, not ti: exceed ten percent of the Lotal estimate, for anticipated unpaid
and delinquent taxes, and such sums as may be necessary to retire outstanding warrants,
indebtedness, sinking fund, bonds, and interest of said municipal irrigation system; and,
WHEREAS, it appearing to the Mayor and City Council of the City of Caldwell,
Canyon County, Idaho, that the City Clerk of the City of Caldwell, Canyon County, Idaho,
as assessor of such irrigation system, prior to the second Monday of December, of the
year 1943, prepared the Assessment Book of said irrigation system, containing a full and
accurate list and description of all the lots parcels, pieces and tracts of land lying with.
in the boundaries of such municipal irrigation system, to which water is being supplied
bysueh municipal;irrigation system, and a list of persons who own, claim or have in
possession or control thereof, giving the number of acres unplatted In such system, and
the number of lots and blocks in the boundaries of such system, listed to eadh of such
persona, which said Assessment Hook is now before the Mayor and City Council, for the
purpose of enabling them to fix the rate of assessment, to meet the expenses of maintenance
operation, improving, extending and enlarging said municipal irrigation system for the
ensuing calendar year, including a reasonable sum, not to exceed ten percent of the total
estimated, for anticipated unpaid and d alin•uent taxes, and such sums as may be necessary
to retire outstanding warrants, indebtedness, and interest of said municipal irrigation
system, said Assessment Book giving adescriptdon of the acreage and lots assessed toe ach
of said persons; and,
WHEREAS, -It appearing, to the Mayor and City Council of the City of Caldwell,
Canyon County, Idaho, that the estimated mount of money necessary for said purposes,
for the use of said municipal irrigation system, for the ensuing calendar year, beginning
January 1, 1944, and ending December 31, 1944, as provided by the estimate on file in
this office, is the sum of 113,442.81; and,
WHEREAS, St appearing upon examination of lands assessed in Calloway Addition to
the City of Caldwell, and which said lands receive water for irrigation from said municipa
system, for the purpose of assessing same proportionately, according to the benefits re.
calved, that each of said t racts of land so assessed receive certain benefits, which said
benefits amount to the sume indicated after the description of each of said tracts of land

Caldwell, in said system and lying north of Linden Street In said City, and in this para-
graph described, for the purpose of assessing some proportionately, according to the
benefits received, that each of said tracts of land so assessed as lots, receive certain
benefits, which said benefits amount to the sums - ndicnted after the description of each
of said tracts of land, to -wit;

and College Heights Addition to the City of Caldwell, Idaho, and not heretofore assessed,
and which said lots are insaid system, and which said lots lie North of Linden Street in
said system, and for the purpose of assessing same proportionately, according to the benef
received, that each of said lots so assessed as lots, receive the game benefits, per lot,
which said benefits amount to the sum of $2.n0 per lot; and,
'NHERSAS, It appearing upon examination of lands in said system assessed as lots
in Arlington Addition to the City of Caldwell, and in Block 105, 106, 107, and 108, in
Goandu Addition to the City of Caldwell, and Block 22, 24, 25 and 31 in Hasbrouck's Re-
Subdivision of Fair Acres to the City of Caldwell, for is purpose of assessing same
proportionately, A ccording to the benefits received, that such lands so assessed as lots
in this paragraph described, receive the same benefit, which said benefit amounts to the
sum of 12.00 for each 25 foot frontage of the lots hereindescribed; and,
MMOEAS, it Appearing upon examination of all lands in said system assessed as
lots or parts thereof, which appear their respective platted additions as lots with no
block designation, for the purpose of assessing same proportionately, according to the
benefits received, that each and every of said lots or parts thereof, within said system,
so assessed as lots, as in this paragraph described, receive the same benefits, which said
benefit amounts to the sum of P2.00 for each 25 foot frontage of its shortest street

hereinbefore described and mentioned, and assessed es lots of blocks in said system,, for
the purpose of as =essing same proportionately, according to the benefits received, that

same benefits, which said benefit amounts to the sum of t12.50 for each 25 foot frontage of

the Clerk of said City upon the Assessment Roll of said system, and shall be subject to
review by the Mayor and Council of the City of Caldwell, at.a meeting called for that
Purpose, as hereinafter provided, and should thereafter be delivered to the Treasurer of

That certain tracts of land In mountain View Addition and in College Heights
Addition to the City of Caldwell, Idaho, in said system, and lying North of Linden Straet
in said City, and in this paragraph described, receive certain benefits which said benefits
are hereinafter designated after each tract of land, so assessed, and there is hereby
levied as assessment on said ttracts of lend so!receiving said benefits, for the purposes
aforesaid, for the ensuing calendar year, the sums indicated after the description of each

That the let day of February, 1944, at the hour of 8 o'clock P. M., Pacific 'Fe r
Time, is hereby fixed and determined as the time the Mayor and Council of the City of
Caldwell shall meet as a Bo of Correction to review and correct assessments as provided
by statute, that at such time the mayor and Council shall meet at the City Hall in the
City of Caldwell, Canyon County, Idaho, the legal place of meeting of said Mayor and
Council, for said purpose, and shall continue from day to day in session, so long as may
be necessary not exceeding three days, exclusive of holidays and Sunday, end the Clerk of
said City is hereby instructed and directed to give proper notice by publication in the
official newspaper of the.City of C Idaho;, of the time, place ®nd purpose of such
meeting, as provided by law.

It is further ordered, and this does ORDrR, that within five days after the
Mayor and Council of the City of C shall have adjourned as a Board of correction,
the City Cleric shall, complete the Assessment gooks andcertify the same, and deliver said
books to the City Treasurer of the City of C who shall publish a notice in the
official newspaper of said City, that the assessments here levied shall be due and payable
on or before the 15th day of March, 1944, and that such notice shall be so published twice,
at intervals of not less than six days, and to be in the manner and form as provided by
law.
WHPMUPON, it was moved by Councilman Newman, seconded by Councilman Thornock,
that said resolution be adopted. Motion carried.
