COUNCIL CHAMBERS
December 17, 1973
8:00 P.M.
The meeting was called to order by Mayor Carpenter.
The roll of the Council was called with the following Council Members present: Williams, Mccluskey, Banks,
Gamboa, Dakan and Carter. Absent: None.
The Madrigal singers from Caldwell High School performed Christmas carols and sold candy and calenders to
Council members and the audience.
MOVED BY Williams, SECONDED BY Banks, to approve the minutes of the meeting held December 3, 1973.

Mayor Carpenter read a letter from Henry Sisson of the Idaho State University School of vocation - Technical
Education. He then presented certificates for completion of the Water/Waste Water Treatment Plant Opera-
tor course to Glenn Hollis, Floyd Tracy, Bill Brewer, Jerry Harness and Joe Franklin.
Councilman Banks informed the Council that the City's insurance carrier has denied the claims of the child-
ren who had suffered the chlorine burns in the accident at the swi mming pool, as after investigation no
negligence was found in connection with the accident. He added that the only way these claims could be
paid would be if the claimants sued the City and the City was found to have been negligent.
Councilman Banks read a letter from John Mouw, adjuster for the City's insurance carrier, to Mr. Hines
stating that because on the day of the accident the pool's filtering plan was shut down due to malfunction,
and the pool's mechanical function was in the hands of R.W. Luekenga, and because the pool's facilities
were out of the hands of the City employees and in the control of the contractor, the insurance carrier
denied the claim.
Bonnie Vance appeared before the Council suggesting that these claims be turned over to the insurance
company for Luekenga.
Councilman Dakan asked that a meeting be set up with the insurance carrier to discuss these claims.
MOPED BY Gamboa, SECONDED BY McCluskey, that:.the City receive a copy of all action taken by the insurance
carrier on all claims submitted by the City. MOTION CARRIED
Earl Reynolds and Roy Taylor of CH2M presented the preliminary report on the updating of the 1960 water -
sewer study.
Mel Lewis read a letter from Jack E. Kelley, Consulting in Engineering and Geology, proposing to furnish
engineering services to the City in connection with the drilling and development of a well at the old air-
port site.
The Mayor read a letter from William W. Blunt, Jr. of the Department of Commerce, the funding agency for the
EDA, which enclosed an offer of grant not to exceed $211,500.00
MOVED BY McCluskey, SECONDED BY Dakan, to approve the grant offer as proposed and authorize the Mayor to
sign the Offer of Grant. MOTION CARRIED
Councilwoman Williams stated that the bicycle ordinance would be prepared by at least the middle of
January.
The Mayor reported that each department head had received copies of the new policy statement to give to each
employee who upon reading it had signed a statement to that effect.
Councilwoman Williams stated there would be a special meeting January 2 at 7:30 which would be held to
fin ish the old business of the adninistration, administer the oath of office to the mayor elect and the
three council members and give the public the opportunity to meet the new mayor.
Councilman McCluskey asked that each member of the Council put their projects on the board he had installed
and also the progress made on each.
Councilman McCluskey stated that he and Councilman Fuller of Nampa were going to get together after the
first of the year to discuss the exchange of equipment with Nampa.
Councilman McCluskey stated that the ordinance covering the public works administrator and planner would be
I presented at the January 7 meeting.
Councilman McCluskey stated that he would contact a contractor to alter City Hall.
Judge Birnbaum appeared before the Council reporting that a fence had been erected around United Metal and
Iron, Inc. The Council then directed the Clerk to issue the junk shop license. Councilman McCluskey read
from the City Code the section outl the discretion of the Council in determining environmental
Countilman Banks informed the Council that interviews had been scheduled for Arthur Collins for January 4 at
2:00, for Dave Higgs that eveing, and for Bill Smith the evening of January 8.
MOPED BY Dakan, SECONDED BY Banks, to set aside time December 24, 2:00 P.M. for an employees Christmas
party, the funds to come from the Council expense account and also allow from the same fund a $50.00 donatior
to the Madrigal singers who would entertain at the party. MOTION CARRIED
Mel Lewis opened the following bids for a 1974 3/4 -ton pickup truck for the lister Department:
Burns Chevrolet Net Price $3,$38.00
Bob & Johns Net Price $3,780.00
MOVED BY Carter, SECONDED BY Dakan, to accept the bid from Burns Chevrolet in the amount of $3,538.00 subjec
to a check of the bids by Jack Johansen. MOTION CARRIED
Councilman Carter stated that he wanted to clear up the increase in golf ticket charges in that the family
membership would be increased to a maximum of $170.00
Councilman McCluskey sponsored Resolution No. 28 resolving accepting the Assessment Roll of Local Improvemen
District No. 70 for the City of Caldwell, Canyon County, Idaho; authorizing the Clerk to give notice of the
time and place for hearing and considering objections to the said assessment roll; fixing the time for
hearing and considering sdd objections and prescribing the form of notice.

MOVED BY Dakan, SECONDED BY Carter, to accept the proposal from Anderson and Kelly for engineering services
for the new well at the airport site. NOTION CARRIED
Mayor Carpenter read two letters which were addressed to Orlando Dalke of the Department of Environmental &
Community Services in connection with grant applications for sewage treatment planning.

BY McCluskey, SECONDED BY Williams, to table the County - Cities Civil Defense claim, subject to a

Councilwoman Williams sponsored Resolution No. 29 authorizing the transfer of funds.

City's share, approximately $3,320.00 of the expenses for the Canyon Development Commission.

Mayor Carpenter reported on the progress of the emergency health task force and its goals in the future for
emergency health services.

Carpenter stated that when Mr. Gipson drew these plans he understood there would be no charge for this,'
the Council had approved his bid, and then the next day had decided to obtain bids from local builders.
