The Council met oursuant to call and acknowledgment of notice in the following form; We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do here- by acknowledge notice of a Special Meeting of the said City Council to be held in the Mayor's Office in the City Hall in the City of Caldwell, Idaho, at the hour of 4:00 P.M. on the 17th day of December, 1970 for the transaction of all business in connection with the following objects: to consider the application for a liquor license for the remainder of 1970 submitted by Leo M. Kunz and Robert Leo Kunz, dba See - 2 Restaurant. Witness our signatu,Tes this 17th day of December, 1970 Mayor Councilman Mayor Charles W. Carpenter presiding. Upon Roll Call, the following Councilmen answered present: Alfred H. McCluskey, James id. "Bill" Keys, V. Jay Martin and James R. Dakan. Absenb: C. A. "Chet" Davenport, and Charles C. Banks. Application for retail Liquor License Mayor Carpenter announced that this special meeting was called in order to hear the application from the See -I Restaurant for a retail liquor license, and he then presented to the Council Members an Oath from the Secretary of State showing the official census for the City of Caldwell to be 14,219 for the year 1970. This increase, he stated, allows another liquor license to be issued within the City. He then pre- sented the application for liquor license for the remainder of 1970, signed by Leo M. Kunz & Robert Leo Kunz, dba Sae -I Restaurant, accompanied by the necessary documents required by the city ordinance, and a receipt from the City Clerk in the amount of $46.88 for the pro -rated fee, also the liquor license which had been issued by the State of Idaho to the See -I Restaurant and a letter of approval signed by Captain Elwood Siegmann, Acting Chief of Police. Mayor Carpenter then stated he had been chatting with Police Captain Siagmann a few minutes before) the meeting, and he felt there was something the Council members should know: before they acted upon this 1 application. He then presented Captain Siegmann who stated that this afternoon Mr. Rex Nelson, who is in charge of investigation for this District for the Idaho Liquor Law Enforcement Department, came into his office and inquired about the See -I Restaurant, as to whether they had obtained a retail liquor license and if not, if they had had a catering permit from another firm that was licensed. Captain Siegmann stated he had checked with the City Clerk and learned that no such permit had been issued. He said Mr. Nelson then went an to say that he had received word from a reliable source, which he could not divulge, that the See - I Restaurant this past week -end had a party where hard liquor was disbursed. It was learned that the party had been for the Government Radar Site located near Wilder, and that one of their men had bought hard liquor in Boise and brought it over here and one of their men had served it at this place. Captain Siegmann stated, "According to my understands if this is true then it would �t , ul appear to me that they are guilty of. two offenses - No. 1, of serving liquor in a house or business that is unlicensed for serving liquor they don't have a catering permit or a license for, and No. 2, selling, serving or allowing to be 45.3 consumed, liquor in a beer licensed establishment - -no matter how it got there or what the cause. If the place is licensed for consumption of beer and not for liouor, they are not allowed to have liquor an the pre. mises, even to give away to their friends. -In other words, the beer license could be subject to revocation.' He further stated, "It is rare that I pack tales unsubstantiated, but due to the urgency of your call for considering this license application, I wondered if it would be possible that if you went ahead and granted this particular license and it did turn out that the investigation was true and the license was revoked, if the City of Caldwell would then loose this source of revenue to another licensee, so I felt that it was necessary that I bring it to your attention. Rex Nelson told me that the Commander of the Rader Group told him he will assist in prosecution or whatever is necessary. It could be that this will be somewhat resolved later this evening as Mr. Nelson is going to try to get in touch with the Kunz' and discuss this with them and find out what the facts are from their side. When we went out to check their place of business they weren't open yet and he had to go back to Boise at that time." Councilman Martin then moved, seconded by Councilman Keys, that action on this application be deferred until the regularly scheduled Council Meeting to be held on Monday, December 21, 1970. A vote was taken and the motion carried. Purchase of used car by Police Department Councilman Keys inquired about a bid which had been let at the last Council Meeting for a used car for the Police Department. Mayor Carpenter replied that he had considered discussing it at this time but due to the fact that the Chief of Police is out of town, he felt discussion should be delayed until the return of the Chief. He further explained that he had received a letter from Mr. Dobbs, of Bunny Buick, objecting to the way the bid was let. That Mr. Dobbs had consulted with the City Attorney and been advised to submit an objection in writing to the Council and the bid would then be re- considered, which is what he is doing. Councilman Martin pointed out the fact that he and Councilman DAkan were not present at the last Council Meeting, at which time the bid was let, and that today two of the Councilmen who were at the last meeting were absent so he felt it would be better to defer action until the next Council meeting when perhaps all the members and the Chief of Police could be present. Mayor Carpenter stated he had suggested to the Chief that he have someone with mechanical know- ledge to check over the cars bid. It was then moved by Councilmen Keys, seconded by Councilman McCloskey that the Mayor instruct someone specifically in the city employe to make an examination of these vehicles and report to the City Council at the next meeting, at which time further action can be taken. A vote was taken and the motion carried. It was moved by Councilman Keys, seconded by Councilman McCloskey, that the meeting adjourn. A vote was taken and the motion carried.
